Social Security Disability Insurance is an entitlement based on what you paid into it, basically an insurance policy. It's not means-tested, you just have to be disabled to qualify (unable to perform substantial gainful activity) and have paid into it.But the kicker is you can't have I believe over 2,000 in savings that includes any bank accounts, bonds, stocks, property, inheritances anything SSI and SSDI are for people not only disabled but also destitute and spouses' income and assets count. So, unless Tammy divorces him he won't qualify for either.
To qualify for Supplemental Security Income based on disability, you both have to be disabled and essentially in dire poverty. Tammy would really have to divorce him for him to qualify for that.
I seriously doubt he qualifies for SSDI with his nearly nonexistent work history and the fact he probably played silly buggers on his taxes too. The question then becomes whether he's actually disabled and you can be in pretty bad shape and still not legally disabled.
So if he could be a full-time Wal-Mart greeter, he wouldn't qualify.
There are also what are called listed impairments, which are specific conditions that automatically qualify you. These are generally pretty dire, like missing two limbs (just one won't necessarily do it by itself). You have to meet two lists of criteria, the so-called A criteria (which mainly just means you objectively have the condition) and the B criteria, which is the objective medical measurements you have to match to qualify.
For instance, just meeting diagnostic criteria for "chronic heart failure" is the first step, but it has to have certain measurable impact on you. This means a giant stack of papers establishing the level of heart failure, what its actual effects are, that you've been being treated or will be being treated and it is or isn't likely to improve with treatment, and most importantly that you actually compliant with treatment, which you can be certain as lawsuit insurance, any doctor seeing this fat fuck as a treating physician has noted in his file repeatedly that the corpulent bastard does not comply with treatment.
Anyway things could get really, really grim for Jackoff if he doesn't qualify for Social Security's insurance half and has to try for Supplemental Security Income. Tammy has to divorce him or they both have to go into poverty. You also can't just fraudulently transfer property over to another family member while still using it. You have to "spend down" until you're at the appropriate level of poverty.
There's also an exception for older people where you "grid out" and qualify for disability if you're unable to perform past work and have no skills that could transfer to the light or sedentary occupations you are still physically capable of doing. Unfortunately for Jackoff that starts at 55.
The dumb son of a bitch better treat Tammy and his seemingly pissed off mother-in-law well if he doesn't want to end up a 50+ year old retard in the kind of single occupancy residence he could have to spend down to to qualify for disability.
Hope he got one of those Cadillac plans when he was still making money and can keep up with it.
