The developer is actively arguing on Steam that neither this nor any other GSC-owned asset is in the game.

The announcement on Steam also has the other half of the e-mail.

Olga Yakovlenko is literally listed as their lawyer.
If you think the name on the DMCA needs to be the name of the person writting it, and that the person writting it can't just make one up, you're a retard nigger, however I AM WRONG.

I was thinking someone used the name of one of the old Firelake band members, they stopped working for GSC past 2012 and went to VG Entertainment.
I still don't think GSC saw red blood and decided to strike them for being Russian as Stalcraft never got struck neither the myriad of other projects using these, and has helped people get their channels reinstated and stuff back online despite being russian or what they said about GSC.

Most of this is just gibberish, emissions are definitely something the Misery dev copied since they didn't appear neither in the Tarkovsky's movie nor the Roadside Picnic iirc, but they're very vague about other points.

The textures do resemble the textures from og games, at least from CoP, it would be sad to see them being left in the game files since the game itself seems to use a grayish texture on the helicopters found ingame.

Doubleposting like a dumb nigger, but okay, this changes things if it's true, but this just seems like leftover files. The helis in the Misery game don't resemble the supposedly stolen asset at all beyond obvious irl reference.

The latter is an Mi-6 and is a completely different kind of helicopter

Correct, which is why the 4fag screenshots seem fishy to me. If any kiwi has the game on steam, please consider booting up Fmodel and verifying these claims.

There's an Imgur album with "proof" of the stolen content, these two screenshots are included;

Personally, I've been skimming through some gameplay videos and haven't seen a single Mi-24 in-game, the only other helicopter I noticed is this one (which is obviously not the same thing);

I do agree that, IF the model and textures were really found in the game files, it could simply be a leftover that was used as a placeholder for reference and was eventually forgotten about.

These are actually my screenshots lol, can confirm that they're all in the release build of Misery.
Its not actually accessible in the game, just was accidentally included with the files. Unreal tries to only package referenced in-game content in shipping builds but you can override that behavior by specifying directories/files to "always cook" with the build. If you're soft referencing stuff (can be the case with items, etc. data assets) you might do this as a bandaid fix. Here's the relevant part of the DefaultGame.ini file shipped with Misery.

The dev does seem a little scummy but I don't think he directly stole anything.
His other games are a different story... His Steel Ball Run ripoff game has a bunch of ripped models but is still on Steam for some reason. Steam Discussions for that game indicate he was selling access to the full game for $10 on Discord, perhaps bypassing directly releasing on Steam while still using it as a distribution network. The app ID for Misery also originally was for some kind of Bleach (?) fangame.

The page of a steam game inspired by stalker called "Misery" has been taken down by GSC for alleged copyright violations.
The full email hasn't been leaked by the developer himself, we don't have the full context of this violation. However, here's a couple of screenshots and pics from the game's discord. If it's just the generic commie bloc apartments, then this dmca sounds like total bullshit.

GSC is acually overdosing on cope. From a franchise that is literally built of the world of a book, one would think they would know that you can take inspiration from things. I guess GSC is pulling a gaymes workshop to sue everyone who takes idea's from their franchise built off others idea's.
It's quite funny how hard the Redditors latched onto this one song to justify taking the whole game down when a few months ago GSC was caught stealing code from Anomaly addons... Did the mod author DMCA'd GSC? The original game on which Anomaly and the addons are based on may belong to them, but they do not own the modders' work and have no right to profit from it.
Redditniggers are once again slurping at GSC's boots and claiming that "misery was never fun" and "the dev's where orcs and racists who 100% deserved it!"

I mean stalcraft has its fair share of russian nationalists (so does GAMMA tbh) but no action has been taken against them, considering both of them also have some form of monetisation in place (paetron for GAMMA and in game currency for stalcraft), so it doesent really make sense to me why misery, a relatively small game (peaked at 12k players on lauch) would be the only one getting struck here.

I think some game company (maybe Bethesda?) did claim ownership over all user-created mods
Blizzard and Games Workshop I know both did that. Bethesda as far as I know doesn't even claim ownership over Creation Club content. The only thing they really have a problem with is using assets from one game in another, I.E. voice files from Fallout NV into Fallout 4.

GSC is more liberal with their requirements, their modding guidelines are more of a "if you are within these then you're protected by us", these include xray forks.
They allow the use of all their assets and code within engines that are derived from xray, however you're out of luck if you want to try to port their shit to a different engine.
Though they also try to put in a "don't be hecking mean" clause there which, doesn't get used because no one gives a fuck.
What I find interesting in their Guidelines is that, they even admit it themselves that, they don't own the rights to some of the music in the OG Games, so you got to be careful about that.

They didn't win the claim. They just removed the infringing material and thus had the claim lifted by GSC. It's all detailed in the post you screenshoted but didn't read for some reason. They removed 1) the helicopter asset that didn't even appear in the game 2) songs that were cover versions, but that GSC had exclusive license for 3) references/homages to STALKER. So, in every way they just complied with the demand even where they probably didn't need to legally (e.g. I think you're allowed to make Easter egg references to things). It's not some catastrophic loss for them as 99% of the game remains as is and for sale, but there's no basis for framing it as them winning against GSC.

In other STALKER DMCA news, GAMMA repository got hit by one.
1763249737554.png
The reason? MartyMods, power word Pascal Gilcher. No need to call him by his stupid nickname stolen from a movie when he's more than open to letting people know his legal name. More specifically, one of his Discord mods sent a blanket DMCA in his name, for mods that are publicly available on his repos, and caught one of the biggest STALKER modpacks with it.

Now, this Pascal twat is:
-German
-has a massive ego for "creating a ray tracing shader"
-keeps this shader behind a paywall despite promising that it would be released for free
-believes that mods should be paid and refuses to listen to anyone who says otherwise, which is most people
-created a fake malicious version of it that would wreck people's ReShade configs to "punish pirates", which is a great thing to put on your resume next time you look for a job in coding
-would gladly waste his time arguing with people who pirate his shader despite claiming he keeps it paywalled to support his parents that lost their jobs during COVID, which is his excuse for not fulfilling his promise of making his shader free
-he is butt buddies with ReShade devs who are as fucked in the head as him and always bat for him as is common with mentally ill people, just take one glance at their home page

And I really fucking hate the guy so it brings me immense schadenfreude to see him fuck himself over this hard.

This wouldn't be nearly as much of a problem if GAMMA had like, a compact install that you could back up and share around, as opposed to a retarded overengenieered glorified launcher.
