It's not super common but there's no reason a party can't show up for another party's deposition. So long as there's no reason to think he'd violate the protective order, he has as much right to be there as the other side.

I noticed that too. Man to get that video deposition. A steely faced marine sergeant sitting quietly and staring at Waid, while he tries to wiggle and squirm his way out...

Some of the pages are missing in the deposition, i'm guessing that's all personal stuff not related to the lawsuit.

It's not terribly credible from a man whose introduction to the court was perjury. The case hadn't even started and in a doomed jurisdictional motion, he flat out committed perjury and immediately got caught.

The fact is this man has zero credibility to the court. Nothing he says from now on can be believed without corroboration. That was about the stupidest thing this dumb motherfucker could have done.

Intro: Waid did TI in Texas by contacting AP and defaming Meyer at a Texas con.

JURISDICTIONAL FACTUAL SUMMARY: More of what we know. Meyer likes superhero books. Wanted to publish one. AP had agreed to publish JB "by April 29, 2019", making announcement on May 9th. This is interesting. I thought AP had said they didn't know about Meyer's negative prep, but it says "Even before making that announcement, AP was aware of negative reaction within portions of the comic book world to Meyer’s book, and that some stores even discussed plans to boycott the book". Criticism continued through the 10th and 11th.
There was an "email dated May 10, 2018 at 9:48 p.m. instructing AP personnel to observe “radio silence” regarding the JAWBREAKERS controversy and deflect any criticism to its creator, Richard Meyer".

Waid posted is "I have a call in to Antarctic Press" message on May 11, 2019. Waid left a message with an employee saying he wanted to speak to the owner so Waid could make sure the owner “understood why the backlash [was] happening.” Quote: "AP’s office manager conveyed Waid’s message to Joeming Dunn, AP’s owner, at 12:25 p.m. stating that Waid was “looking to warn us of how badly our associati on with Rich Meyer might be for us,” and had “mentioned death threats, among other things.”

This is interesting:
Frustrated with being caught in the middle between Waid’s followers and Meyer’s supporters, Dunn sent a lengthy screed at 4:38p.m. to one of AP’s contributors complaining that AP was being bullied into not publishing Meyer’s comic book because of past statements and political viewpoints of an author that were unrelated to the book being published."

Tim Lim maybe? Didn't he introduce Meyer to AP? It says AP made it clear that they hadn't decided to cancel the book by then. After sending the email to the contributor, Dunn called Waid back. It wasn't a short call, like Waid made it sound. It lasted 27 minutes. After the call, Ben Dunn said his brother was “visibly upset”.

This next part kills Waid: Before that call, Ben understood that AP remained committed to publishing Meyer’s book. Thirty-six minutes after the call between Dunn and Waid ended, Dunn sent a text message to Waid’s phone stating, “I have decided to drop the project,” He then told a AP lackey to make that Facebook post announcing the cancellation. Waid then texted Dunn back saying: “You are a VERY good man. Text or DM me when the statement goes up and I will recirculate it if you’d like.” What a scumbag.

Next they just go over the idiotic bragging Waid did in articles, which we know about. Waid and Dunn continued to text in this time. On the 15th Waid sent a message saying “Holding up? Why in the world is Meyer claiming that you called him in tears?” Dunn refused to answer, to which Waid texted him “I don’t blame you. You haven’t turned on me, I hope?” This guy is such scum. Waid then desperately texted Dunn begging him to say Waid didn't bully him. To be continued in my next post. This is getting too long. More juicy shit to come.

Well, looks like Meyer hired one hell of an attorney. Kept his mouth shut, filed a document which dropped bombs on Waid's actions and so far (and I don't think I am alone in believing this) has appeared to be far more competent than that spastic Zaid.

Oh yeah. But in all honesty Waid himself did all the work here. I mean how the fuck do you defend such a fucking retarded idiot? You don’t often find a defendant that leaves a time stamped log and transcription of his efforts at Tortious Interference, and his desperate pleas for people to lie about it.

Although I think the House of Mouses lizard eyed corporate council is probably happy. It’s clear that this entirely came from the deranged and moronic mind of Mark Waid, and doesn’t reflect some broader business action by the Marvel Comics twits.

To be fair to Zaid, I think he was blindsided by Waid flat out lying to him and giving him a perjured affidavit in support of that jurisdiction motion. I don't see an even half competent lawyer knowing what the fuck Waid was up to and signing off on it. The fact that Waid's legal team almost immediately took him to the woodshed and "revised" his perjury is really consistent with getting caught completely off guard by their moron of a client.

I also might be full of tinfoil on this but I strongly suspect Zaid is there largely for the Mouse or other corporate interests and is making sure this shit doesn't blow up in any way that directly affects the greater corporate concerns involved.

This isn't good for Waid but is good for Meyer and the Mouse.

The stunt Zaid pulled with the CIA whistleblower makes me seriously distrust the dude. And again, probably tinfoil on my part, I just think the guy is a fucking weasel. Waid deserves him.

Does anyone with a better recollection of this series of events care to match up Waid's smug public postings about how he didn't bully anybody and his private text messages begging for retroactive absolution? :story:

Zaid seems to be down with the wokeness, so he probably listened and believed instead of doing his homework. He gives off the impression that he thinks he's hot shit but in reality he's probably just lukewarm shit at best.

You’ve gotta feel bad for Waid’s poor little Texas Attorney. She did nothing to deserve this. How much do you want to bet she was completely blindsided when those lengthy streams of texts got dropped on the table during deposition? Or the “brief” phoevall that turned out to be a 27 minute screaming and bullying session? I’m thinking even Florida Lawyers would find Waid to be outside the expected spectrum of lunacy, stupidity and rage that they have come to expect from clients.

Hope springs eternal, this is looking increasingly likely to go to summary judgement if Waid doesnt wave the white flag
 
Waid’s Lawyers have got to be screaming Settle Now! Also what does this do to their Anti-SLAPP argument that they got postponed until the Jurisdictional question was ressolved?

I think the jurisdiction motion gets denied, they try a TCPA motion and lose that, too, and then the case gets settled based on what's come out as of that date. It might not be a particularly fun or dramatic end but will probably be satisfying for Meyer.

The TCPA motion is a real Hail Mary and the shit Waid has said and done is going to look like absolute shit in front of a jury. Meyer knows this. Waid knows this, or maybe he doesn't because he's just that fucking dumb, but his lawyers do. This doesn't go well if it goes to trial.

SLAPP is on the pleadings, so it doesn't really do anything to it. It's increasingly apparent, though, that Meyer actually can prove his case in chief if it comes down to it so aside from somehow getting all the evidence thrown out, Waid can't win.
