Waid's cult won't be happy if he settles. It will be easy to spin it as "making a deal with an alt right neo nazi" which means he runs the risk of being metoo'd or just thrown to the wolves. Especially if what's been discovered is bad enough for him to want to keep secret. I don't know what the law is about learning about other crimes while investigating another are, but I think it's reasonable to assume that other people in his clique will know some of what's been uncovered already. He cant take a silent deal if he wanna protect his brand. He needs Waid to make a statement publicly that what he did was wrong and he needs a non disparagement clause.
Even if it's not criminal, it's reasonable to assume there's something that will damage his career beyond what is public knowledge already. And to put that into perspective, it's public knowledge that Waid smashed up a store during one temper tantrum. Whatever he wants hiding has to be as bad or worse than that.
If he's forced to settle, then maybe he can get out of it by claiming the courts are in the pocket of Trump, Putin, the alt right, etc. But most of his followers don't even know what the lawsuit is about, so I doubt they know what @AnOminous said about having to take a settlement to not waste everyone's time.
Edit: For Mayer, simply walking away with the money and a verdict will be enough for this to be considered a win. While Waid being made an example of would be nice, I think the best outcome for Mayer is if this kind of lawsuit becomes common practice. I don't know if the Honey Badgers won their Calgary Expo lawsuit, but if they did this could be a wake up call for SJWs that there are limits.
