Genuine question: is drawn CP CSAM? - Not limited to anime

I've been torn on this question for a while. I've delved into some cases like the Australian loli court case or numerous drawn CP cases in America.

Generally drawn CP isn't even considered CP in some countries, yet in others (usually the more developed/richer ones) it's considered CP, but only in specific cases its also CSAM (like when a artist draws a real life child, shadman comes to mind)

Users in furry drama general don't view it as CSAM, and made a solid argument. What does Q&A think?

My personal opinion is that drawn CP is CSAM if the artist draws a real life child (at the time of drawing) in explicit situations without the child's nor the guardians consent, otherwise it's drawn CP.
Edit: a child cannot consent and a guardian should not be doing such a thing. It's CSAM however you look at it. Legally it depends on the country unfortunately.

Even with consent its fucked up and should be treated as CSAM. I can't imagine what guardian would consent to such a thing.

and whatever the fuck MAPS mean when they say they should have access to fake CP, in a country like america, where they literally already have access to it.

Lurked, wanted to clarify (sorry if one-time posts are not appreciated) that they're not supposed to have that access.

Gov should do more but they only have 8 cases (6 there, 2 here) and websites like Gelbooru (holy fuck 481K) , Pixiv (god knows), and F95 (1326 Games) should have, at the very least, gotten restrictions.

If you're curious, PROTECT works in the same field of law as regular child porn (being Obscenity law) and yields the same min and max sentences, it's defined here.
However, due to the FSC (and the Crunch Wrap Supreme Court) being a bitch, the prosecution is different (and more complicated).

With regular CSAM, judges will just lynch you unless you prove you were gonna report it or that whoever reported you is lobotomized.
With FCP, the court has to run it by the Miller Test (it has to tick all three):
1-Is it horny?
2-Is it offensive? (default answer is yes, to children).
3-Does it have any merit (means 'good' FCP is allowed, but good FCP is impossible so who cares)?
This is little more than a formality and it's basically impossible to pass the test with FCP.
