IMO the American comics industry fucked itself in the 90s by shifting focus from kids to the spectator/collector market and flooding the stores with unsellable crap like foil covers.If the comic industry was doing well before the shift, I think they wouldn't have had to look outside the community, but I guess Comicbook fans are partially to blame for the transition. If they just bought more comics to keep the industry afloat. But as was said before by others, the distribution chain needs fixes.
I still think its risky, I recall Shazam getting put under pressure from DC back when Shazam went by Captain Marvel at FC, Even though Shazam was its own character with its own origin story and powers different from Superman.
Nintendo is also very sue happy, not sure about Sega. So Nintendo would put out a C&D.
Now the current crop of idiots are doing their damnest to destroy that market failing to realize there isn't another safety net like the comic shops in the 2000s to catch them if they crash this time.
