Chris is in a fairly rural part of the state, and the population density is pretty low.

Yes, but that's in the Northern part of the state, where it borders on DC and Maryland. Places like Arlington, Vienna, Reston, etc. are commuter belt for DC. Charlottesville isn't; it's about 2.5 hours from DC.

Charlottesville is about the 20th-largest city in Virginia. Has been for some time. It's not really a sprawling metropolis, though UVA can make it seem that way. Traffic there sucks.

The Commonwealth's Attorney (equivalent to the DA in other states) in Charlottesville does not have jurisdiction over the case as Ruckersville is in Greene County and Charlottesville is in Albermarle County.

You drive through nothing to get to it and almost everything there is sparse also. Charlottesville could be described as a small town that accidentally thinks its a city. The only really populated parts of VA are NOVA (Alexandria et al), Henrico County (Richmond only, basically), Hampton Roads (Norfolk, VA Beach, Chesapeake, Newport News, etc), and MAYBE York/James City County (Yorktown and Williamsburg). Even the last two are well known but I'd hardly call most of the cities "densely populated).

AMA is Against Medical Advice. It's where you can legally walk out of the hospital, even if your doctor really thinks you should not. Provided you are competant to make your own decisions. The fact that Barb has not done so is a pretty strong sign of what the evaluation findings were.

Keep an eye on what if anything happens to Barb in the next few days. If she is still in the Hospital they may try discharging her to a nursing home for at least 1 day. Medicaire gets weird about hospital admissions that go past 30 days. The trick is to discharge them, then readmit them a few hours later so it becomes a new admission, reseting the clock.

You gotta figure, he did this every 3 days for over a month. 8-10 times? Maybe more? He would’ve gotten pretty comfortable by then, and Chris records everything. From shitting on the floor to yanking his flaccid pud, there’s been nothing too shameless for Chris to film.

Yeah, I'd mostly agree with that. Ruckersville is definitely more on the rural side, though. Really, it's pretty much an exurb of Charlottesville at this point - half commuter traffic to C-Ville, half people who work locally.

That pretty much describes its geographic location to a T. Staunton is 45 minutes West on I-64; Richmond is about 75 minutes to the East. In-between, there's just not much of anything, and no truly major North-South routes in or out. Frankly, if it wasn't for UVA, the town would be lucky to be half the size that it is.

Using Albemarle County (of which Charlottesville is the county seat) as an example, I recall it as having a population of around 105,000. Charlottesville has a population of about 45,000. Two-thirds of the residents of the county are rural, and this is a pattern that's seen throughout Virginia as a whole, exceptions above notwithstanding.

I doubt Chris recorded anything incriminating (he records stuff for interaction, but in this case Barb was his interaction, so no recording neeeded),
This brings up something I've been mulling over re: ILJ's recording of her calls with Chris.

Basically, the statute in Virginia that covers recording of phone calls is § 8.01-420.2. Limitation on use of recorded conversations as evidence. At its core, there are two parts to it: one establishes that in order to be able to submit a recording of a call as evidence in a civil case, all parties on the call were required to be aware that the call was being recorded. The second part states that, with certain limitations, a call that was recorded without notification but that demonstrates criminal activity can be submitted into evidence in a civil case.

I'd like one of our actual lawyers to weigh in on this, because the second part has me somewhat confused. If the recording shows criminal activity, why only allow it in a civil case? I feel like there's something I'm missing here.
Private citizens not acting in a professional capacity do not have a duty to report in Virginia. ALL PERSONS have a duty to report elder abuse in Texas (with incest specifically mentioned), where she was at the time, and the way I read the law it doesn't seem to specify where the crime-to-be-reported takes place. I highly doubt Texas would bother prosecuting this for a crime in a distant state though.
Agree re: Texas being unlikely to prosecute her. However, my interest in this angle was more how much in alignment the two states' laws may be. What I can potentially see happening is that she's subpoenaed to appear (either in-person or remotely) before the court in VA; given that she was one of two primary sources for the recorded material, she's a witness.
Winning strategy for the state: Find the best, most attractive big-boobied female assistant prosecutor and Chris will just do whatever she says, ignoring his own (male) attorney. Possibly while beating off under the table.
If you can't see both of his hands, it's probably safe to assume that he's jerking it. And even if you can, he's likely figured out a way to trib himself off.

According to Chris, it was multiple times, so I think any chance of a light sentence is out the window, there's also a few more charges that could be tacked on and Chris is functional enough with people that the Jury could end up finding him to be a giant piece of shit. It's why members of juries are often asked not to look up the defendant, they could find stories/evidence of crimes outside of what they're being tried for which could muddy the trial.

Dementia or not, you can point out three crimes in the matter of Chris raping Barb. You've got rape, incest, and elderly abuse. Multiple counts of it in statements made by Chris. Chris' lawyer would be dumb to go that route though, since any lawyer worth his lick of salt would just point out that Chris has never taken any advice that would have been helpful for him and bettered him as a person. He only did the things that got him what he wanted when he wanted it, to Hell with everybody else. It's a toxic mindset that any prosecutor could use to make anybody look like a giant piece of shit.

A lot of people seem to think that Chris himself got lucky, and don't realize he's never committed a bad enough crime. The only one he could have gotten in serious trouble for, Synder asked the Judge to be lenient. That wasn't the 'Tism that saved him, it was Synder being an upstanding person and not wanting a stupid decision to potentially ruin somebodies life.

I wouldn't be surprised if the prosecutor tried to subtly push Chris into his tard rage by questioning his sanity or mental capacity, a good outburst could sink Heilbergs entire argument and make any attempt at salvaging Chris nearly impossible. This guy took the wrong case because it's going to be nothing but a headache for him. Not only did Chris plan this out, but scuttlebutt says him and Barb were greatly exaggerating how bad Barb was for pity, and one of his neighbors on a facebook post said was a lot more intelligent than he let on. For everything that this case is worth, Heilberg is going to have a hard time trying to argue anything other than "Chris was a retard whose shit attitude and no desire to be a better person and to treat people kindly resulted in him not having anybody to have a mutual relationship which sadly resulted in Chris getting this idea that banging his own mother despite her wishes and pain was the only solution to his problem." A plea deal is the only thing that will save Chris from his life being completely destroyed, but lets just face it. You don't need sex, it's not important to live, it's simply fun to have and lets your family legacy move on. Plenty of people go their entire lives being a virgin and don't rape their own mothers.

Optimistic at best, it's going to be hard to argue not charging him with rape and or incest. You can't sugarcoat his crimes, and don't want to send somebody like Chris back out into the world with everybody knowing that he puts his own needs before others and is 100% fine with hurting others to sate his own desires. There also isn't a misdemeanor for his crime. Mother/father/son/daughter/grandkid is a class 5 felony. If Barb is found to be just as guilty in this as Chris is, she could be charged with a class 3 felony. Misdemeanor incest is basically brother/sister/cousin, generally anybody whose relationship is not that of a parental figure.
He may not "need" sex, but I think it's unarguable that Chris's sexual frustration is part of what led to him doing this horrible shit. If he had just kept hiring prostitutes like he did once or twice before, the most he'd be looking at is a misdemeanor, assuming anyone cared enough to arrest him and charge him in the first place.

That's another part of his problems honestly, he never really learned how to budget money properly, you can get a decent whore for somewhere between 150 to 300 dollars, and he probably could have afforded that expense a couple times a month if he wasn't always wasting money on stupid shit.

While a hooker might satisfy his need for sexual attention, he also wants physical. Cuddling, etc. Sure he could also hire one for that, but ultimately he'd go for what takes him the least effort, Barb.

Personally, I wouldn't want a single fucking thing from that house even if I were still interested in little kids toys or something like that, unless that is, said stuff had been thoroughly cleaned first. Think about how filthy and unhygienic that place and anything in it must be for fuck's sake.

It's also not clear why subpoenas would be required when everyone involved in the crime is either in custody or not going anywhere in a hurry.
Isabella has some arguably relevant evidence. I'm not sure the prosecution will be interested in wandering off into the weeds about it, but the defense might want to muddy the waters with whatever bullshit it can.
I think the biggest thing preventing Chris from demanding a trial is that he can't get an instant trial and instead would have to wait many weeks or months for it to even happen. He'll only demand a trial if he feels he *must* showboat while demanding it (and thus the showboating is the reward rather than the future promise of more showboating ten million years in the future).
He'll have no choice if the prosecution doesn't even offer a deal, unless he wants to plead guilty to everything, which could include rape and a possible life sentence. That was the boat Nick Bate was in.
