As is so often the case with Flynt/Wu, that series of tweets makes no damned sense whatsoever and reveals his usual stunning ignorance of facts that are widely know among high school students..

This isn't even the dumbest shit he's said in the last couple days. The award for that would have to go to his claims of how he'd filibuster in the House, which doesn't allow that. And this despite (allegedly) interning for Trent Lott, a Senator, in the body where the filibuster actually occurs. The absolute imbecility of that claim makes me doubt that ever actually happened. If it did, John is so stupid he can't even learn basic facts from things he actually did.

That was actually part of Commander Stryker's backstory :jace: He supposedly at one point "pled up" from a misdemeanor with jail time to a felony without.

I'd bet quite a bit of money that Sen. Lott had the good sense to keep his influential donors' aggressively creepy and obviously mentally ill gay kid locked in the mail room for the duration of his unpaid internship. I also think that if Flynt/Wu was stabbed in the head during his time in D.C. that Sen. Lott's alibi should be checked very carefully.

That's kind of...I don't even. A felony on your record is way worse than a misdemeanor. I'd take the misdemeanor with jail time over a felony without any day of the week. Felonies kill your job chances, right to vote and carry a ton of penalties. They also aren't easily wiped

Misdemeanors are much easier to get rid of than felonies.

Anyone who managed to plead UP to a felony would instantly end their career as a PD. I doubt a judge would allow it if they knew of it either. They can and do reject plea deals, and that's exactly the kind of stupid shit they're supposed to shut down.

Everyone has some idiotic ideas or opinions, or might have the occasional brain-fart everyone else laughs about. But tweets like this show how much removed from 'normal life' Wu truly is. She recommends a game, that looks like "that one facebook game your aunt plays all day", to everyone and claims it is worth $30. This sounds like the complete opposite of 'the sensible thing to do'. Also I am going on a stretch here, but this tweet has the stench of a shill all over it.

This is actually, as far as I know, not even possible. No judge would allow a defendant to plea to something the state itself has admitted it cannot prove, which the state has tacitly done by choosing to bring misdemeanor rather than felony charges. A defendant can only plea to elements contemplated by the charges listed in the accusatory instrument. Pleading to anything not within the four corners of the document would in fact be self-incrimination and a violation of the Fifth Amendment. So not only would the public defender's career be over, but the judge would most likely be quietly put out to pasture for sheer incompetence.

Sheer Incompetence! It's the Wu motto.

Some states do this as a kind of shakedown, where you can plead a minor violation like speeding that comes with points that raise your insurance rates "up" to a more "serious" charge that costs a lot more but you don't get any insurance points. This is basically flat out bribery (i.e. pay the state a grand or so now rather than get raped by your insurance company for the next three years), but so far, isn't illegal.

Legal-geekery inbound: that's permitted because speeding tickets (short of allegations that include something like reckless driving) are violations, which are technically speaking not crimes at all. You can plead to worse levels of violation than the state can prove because no criminal jeopardy attaches to them. If there is some sort of constitutional breach, most states are smart enough to keep the fines low enough that no one's going to bother challenging them in court, similar to how states that have kept their fines for being caught on red light cameras manageable have kept them in operation despite them being ruled unconstitutional in nearly every jurisdiction they've been challenged.
 
Some days, I honestly wonder if Wu actually remembers that she is supposed to be running for office, or if the "As your Congresswoman" line has become another another of her nervous tics like "I am a woman in tech," or "I was born a born black child in Mississippi," or "<3 <3 <3"
