He was also wearing a “white pillowcase with holes cut out for the eyes,” (referred to as a “hood” for most of the document) but aside from that, yeah, he just said “nigger” and walked away. The specific charge was “level 6 intimidation,”* and he received a 30 month suspended sentence. It happened in Muncie, Indiana and was later appealed, with the appellate court upholding the original verdict.

The arguments from the prosecution- at least as written here- barely discuss the hood, focusing mainly on the word nigger and arguing it’s inherently threatening to niggers. The document also confirms that he said and did nothing else. He didn’t run at her or say “i’ll kill you, nigger” or anything like that. This was a cop, too. I imagine most of them have heard some far worse things, like actionable threats against their family, or stuff. It’s surprising a cop would be so thin-skinne- oh, a lady cop? Never mind, the overreaction makes perfect sense

*To be level six, the intimidation has to meet one of the following criteria:

B-E are obviously not at all relevant, whch means the criterion that was met must be A, “the threat is to commit a forcible felony.” Which felony would be threatened by the word “nigger?” Well, according to Officer Phillips, “lynching, murder, and rape.” Yes, really, (page 12, section 20) and the court and the appellate court both accepted that. Yes but now the precedent is set that the no-no word is a threat under the criminal statute. True, he was also wearing the hood, but the verdict seems primarily based on the racial slur.

It’s unsurprising they find another thing to blame whitey. As a white woman, I see my doctor every year for an annual check up and I don’t have unprotected sex with strangers (never had an STD in my life). Must be racism and systematic oppression or whatever

They give STD tests for free to women under 25 as they're considered a high-risk group.
