Yes, because if you just plead guilty, what do you have to negotiate with? It's anticipated that a defendant is going to plead not guilty, and possibly engage in motion practice before the trial, such as to exclude evidence like contraband seized in violation of the Fourth Amendment. If the defense wins that motion in a drug case, the case is basically over and they usually give up, and if they lose, the defendant usually pleads guilty to something.

A plea bargain is sometimes not even reached until the jury has already been empaneled.

That even happened to me when I got jury duty. So I got to sit around for six hours drinking old coffee and eating vending machine food, only to be called upstairs, and then immediately dismissed because the case pled out.

anyways all the defense laws aside- it stands to reason that if you feel comfortable enough to fire a warning shot you’re probably not in life threatening danger. If you’re not prepared to shoot someone you shouldn’t have introduced (and escalated the situation with) firearms. This is a hurdle that I absolutely do not envy his attorney. I figure they’re going to go a little harder on boogie bc of all the play it got online and on the drama channels.

If they impose new criminal liability, they're an ex post facto law because they're punishing someone for something they couldn't know would be made illegal later, but this amendment makes something legal that was illegal previously. It doesn't give an effective date, so I'm going to assume (and you know the dangers of that) that it took effect immediately, but I'm not sure about retroactivity.

I think the prosecutor believes he can win with either interpretation though. If I'm reading the amendment properly, it extends the protections previously reserved for the "castle" to anywhere a person is lawfully present, and deletes the language about duty to retreat, and possibly other things.

I don't think it's relevant to Boogie either because he had no duty to retreat anyway.

This makes the protection similar to other SYG states like Florida. It doesn't seem to give a special hearing on the issue before trial, though, which Florida does.

Did you even read what he was charged with before speculating? It has nothing to do with stand your ground or a duty to retreat. he has a duty not to fire his gun in the middle of a city for no reason.

idk I know the justice system loves incarceration but I think that's usually more about violent crime and drugs. boogie's case is the kind where the state will act like their priority is not taking responsibility for housing and feeding another retard. at least that's the only way I can rationalize how I've seen courts act personally.

He's stupid but not much of a threat to others because he rarely leaves the house and is so fat he can barely actually leave the house.

He's not as stupid as Chrischan though, and he looks less disabled in the mental sense but also looks more normal visually. Boogie could get the "behave and go to therapy and get a rose trophy" treatment. But because he's not as visually exceptional and has no paper trail history going back to his schooldays of being special, he might get some time in county.

My vote is that they don't really do much though. Biggest mitigating factor after his size would be how many meds he takes, doctors visits, etc. Prison is better set up for that sort of care than jail.

But it's not like giving him house arrest would really be different than what he already is doing (and most of us because Covid) They could restrict him from streaming or social media, since the offence stemmed from online related stuff. Though he could argue that is his job. It's not the same as restricting a pedophile from the internet when they're released on bail or as part of their sentence. If he was restricted he would just play games, vlog reviews to post later while whining about how the mean man who he "didn't even unload lead into you guise" made the review too late to be relevant, and prerecord other videos to release once his sentence was up. Return of Francis, more whiny and angry than ever.

That's right in the statute. The analysis of whether deadly force was authorized is at least partly based on the lack of a duty to retreat. If you meet every other element that justifies the use of deadly force, but have a duty to retreat, then you still can't use deadly force without doing that first.

So part of the analysis would involve that, since Boogie's only real defense is that he was justified in his use of force. If it came down solely to that one issue, Boogie would win. But he completely fails every other element of self-defense.

He cleared wanted to claim he had been arrested before to look "badass" or whatever and that was the most plausible story he could think of at the time.
