You misunderstand the tranny mindset.

He doesn't care about winning. The goal is to inflict suffering onto Null and the userbase, and thereby make us less willing to fight against this. Elliot has unfortunately for himself forgotten to factor in that a cornered fox is more dangerous than a jackal. Do not put people who are otherwise simply posting memes of you on their own website, contained and away from the prying eyes of the wider, crazier Internet on blast and force them to go on the defensive, because it's likely to get your throat torn out in self-defense. Metaphorically.

He doesn't want to take this to trial. He just wants to Dox kiwi farmers. The subpoena's are obviously being issued in bad faith, but proving that is a pain in the ass. The KUSK lawyers should be careful how hard they push this because they are treading a dangerous path for their law licenses if Hardin or the users attorneys are able to prove bad faith. At a minimum, Dong Gones lawyers will be required to retrain on copyright law and have to pay out their own sanctions penalties (in addition to what Dongus would have to pay) at the absolute worst end for how this could go for them.

Of course, that all depends on how the judges see it, and who the fuck knows with that.

He can get the dox of the users regardless of what the lawsuit in NY does. It's part of the DMCA process. Lolcow is suing to clear up its own secondary liability, but the claim against the users still goes because the DMCA is a shitty law.

The DMCA does have a fee shifting provision, so if it is found to be bad faith there's every chance Null and the Does legal bills get paid. Someone like Greer can just claim he's a retard and avoid that sort of thing. A high priced law firm likely would be held to a higher standard.
 
So…what I’m gathering from this is that as long as you stay away from uploading any pictures of Elliot, links to any audio/video media featuring him, or any screenshots of his social media, you’re effectively in the clear, thanks to our grorious First Amendment? Its how Don Sargon got paid by that bitch Akila Hughes. Funnily enough, in the Southern District of New York as well. Which means Hardin can bring up Hughes V. Benjamin alot in this case since its basically the exact same fact pattern. The only real difference is Hughes very publicly stated she wanted to use the copyright act to get back at the evil chuds. Dongus has been smart enough to not outright say his manifestly obvious intentions publicly.

The thing is it has to be something he has the copyright to or was assigned to him. For instance, Judy Tester took a photo of Elliot on a train, that's not Elliot's property and can be used for as much mockery as wanted. The trick is anything you post you'd need to verify the providence of.

The information is already out there, whether it’s posted in memetic form over his face or not, and whether he tries to erase it or not. He can’t DMCA the truth: Liz (also known as Elliott) Fong Jones is credibly accused of non-consensual sexual contact. And he is choosing to create a missing-stair problem by attempting to remove all reference to his predatory behavior.
