IANAL, but: My understanding is that prosecutors tend to go for the charges they think they can win without a lot of effort or time rather than every single instance of criminal activity. No one in this situation has covered themselves in glory, but we know (per Aaron) that Qayla would lash out at Nick's retard behavior, generally with projectiles or verbal lashings.
