Altered how? The stream on his YouTube and Rumble channels is a full and accurate copy of the stream. It's even still up on his Bitchute, I believe.

Then they go on to say that he privated the video on both platforms. Which is true, but they easily could have gotten a copy before then. He didn't private it until many hours later. I assumed they might have been watching live and gotten a copy immediately.

From what I've seen of this Barneswalker's performance so far most of the arguments he makes are probably a little dumb but I don't know enough about the law to really have any opinion on them. What does interest me is that they're claiming here April was questioned by Detective Pomplun after she was read her Miranda rights and asked for a lawyer, and after Pomplun was told she had asked for a lawyer:

I thought the whole point was that absolutely anything you say after Miranda can and will be used against you however is possible? And it is up to you to actually shut up... Maybe this is from Nick's law school...

It's the YouTube channel watermark in the lower corner that provides a "subscribe' button upon hover. It would actually disappear if you downloaded the video with yt-dlp or whatever. :story:

I am admittedly not knowledgeable enough to know if this will work to get the warrant tossed. I'll leave that to the practicing attorneys. There might be some "best evidence" rule that requires the video they are using to be directly from Rekieta's channel, and not a copy from BI. It's also possible Frank is just throwing a hail mary and this is a B.S. defense.

What I do know is that if this does work in a legal setting, and he walks, it's not gonna work in the court of public opinion. Everybody saw what they saw, and @Peace Through Power correctly notes the BI copy is not altered. If it works, it screams "walking on technicality."

I always interpreted "taken off" as "downloaded from," but I guess that language could also support some other channel has "taken off" the video and the detective watched it there.

This says the cop viewed the video on the 22nd that were taken off of Youtube and Rumble, at an earlier time. Nick didn't private the videos until 10:30 the next day since he was wasted and passed out, so they were public for about 10 hours on the 21st. The cop could have easily archived the videos in that time, then made time on the 22nd to watch his archived version. Nick is trying to lie and make it seem like the stream was never public and there's no way the cops could have gotten it on without a warrant to Google.

He could claim that he put the powder there for "comedic effect", but it was actually just powdered sugar! Or that he edited the video himself because it's his channel and it's all part of his "character" to pretend to be a junkie loser. I doubt this is going to be successful.

I am surprised to see Kayla got representation and Nick is going to fight. I was convinced she would take the plea and Nick would let her take the fall. Something must have happened that blew up this plan. Threesome relationships aren't exactly stable so maybe Kayla finally woke the fuck up and said "I ain't taking all the blame so you and your mistress can walk free".
