I’m betting black woman. A tranny would be tempting, but those are exclusively white and no matter how much they want to clap their hands and believe, a white male will always be a white male.

Libshit justice steps down during a libshit-controlled presidency. At least it wasn’t a good judge. Thank you Breyer, the ensuing battle to decide the replacement will be an absolute comedy.
 
Is it just me or are they shooting themselves in the foot with the timing? Not that I mind or anything, but it feels like it would be worth more politically if he were to retire closer to midterms so they could actually campaign on it. Now they're in a rush to get someone by 10/3, and that means all the energy will be gone from the argument, they won't be able to say 'vote democrat to give Biden a pick now!!" it'll just be "hey look at this we got Bidens pick in and it didn't change anything!"
 
Unless it's a Garland-style candidate it's hard seeing how they get anyone through the Senate on this. Manchin (and potentially Sinema) can hold it up to their heart's content and the Progs will burst eardrums if an activist candidate isn't chosen. Fairly good chance this blows up in Biden's face, and oh boy the salt if it does :story:

They need someone who can sit when the court's back in session this fall, and Justices don't retire mid-term when there are still cases to hear afaik. This is the best time because they still have the votes to put a regular leftist to replace Breyer, it potentially gives the Biden administration a win, which they desperately need right now, and it's something in terms of accomplishments for Democrats to campaign on as we approach the midterm primaries this spring/summer.
 
Going by the way bidens handlers pick em, like the eco terrorist thats running land management, it'll either be Xavier Becerra, a cartoonishly evil gun grabber that was the california AG that's somehow now the head of health and human services, or Chesa Boudin a literal dyed in the wool weather underground member.

Yes. The threshold used to be 60 but McConnell got rid of it to appoint Gorsuch I believe. Ah well, that’ll just make things even funnier if anyone tries to block the Biden nominee.

If, I should add. Manchin and Sinema don’t have any incentive to not support the nominee, unless they’re so batshit lefty that it starts digging under Manchin’s skin.

Acktchually, it was Harry Reid who axed the filibuster for judicial nominees.

McConnell was Majority Leader toward the end of Obama's 2nd term, and blueballed the Dems out of a nomination hearing for Merrick Garland.
