Because it has NEVER worked that way. Why aren't you giving Bush Sr. and Bush Jr. credit for this decision given how the justices they appointed ruled? Nobody blames the presidents who appointed the justices for shit like Dred Scott or Plessey v. Ferguson. The reason being is called separation of powers, you know, one of the basic elements of this country, where the President is separate from the Supreme Court.
