I actually looked in to this. I don't think he need a legal fight. I honestly just think he wasted his money. You have a trade name and a trade mark right? If you have a shop you call Bitwave radio you don't have to trademark that. If someone trademarks that name, you can still use that name as you did earlier in the capacity you used it. It's pretty obvious that someone taking the name doesn't give you any rights over your property.

not a lawyer. I imagine Mersh could fight it, but google's shitty copyright system would probably automatically side with the owner of the trademark. If he actually fought it in court, I would assume would be an easy win and potentially get some damages out of the guy lying under oath that he thinks this content belongs to him.

You're missing the point. @Mersh can keep using the name, but he can't stop Jesse from claiming monetization on his content or reuploading Mersh's content to his own channel unless Mersh sues him in court, and Mersh doesn't have the money for that. YouTube will automatically side with the trademark owner unless Mersh obtains a judgement against him in court.

No it's the other way around. It depends on who used the name first. I am sure faggot can sue mersh for exclusivity over the name but you can't just claim a name somone is using if they have an established brand.

If anybody needs a quick way to capture Youtube streams while they're live, I've posted a batch file over in the archival tools thread. You can set everything up and be recording within a minute.

The important part is that unlike with youtube-dl it will let you record a stream up to where it gets flagged/removed if that happens.
