No Shane, those messages were not “meant for discovery” you don’t even know what the term means. Those were not communications handed over by the opposing side. Those were non priviledged communications freely given to the Plaintiff and Plaintiff’s council, not under compulsion of subpoena or similar pressure. The Plaintiff is free to use them as he sees fit in his case, and to restore his reputation. See Shane what you get wrong in this is this is a civil case. Not talking about things under recommendation of council is a generally good approach to things. But it is not a requirement. The man you have been defaming as a rapist and destroying his career does not have any obligation to keep private anything he discovers until a court hearing. He can put out anything he wishes, no matter how bad it makes the other side look.

The Con exec was not being anonymous. Nick, as a Lawyer and a functioning law journalist, knows who his source is and likely verified that source. He has probably also passed the source along to BHBH with the sources permission. Nick chose to keep the source Unidentified . As does every journalist every single day.
