If you mention a claim or an affirmative defense at all, you can flesh it out later. In fact, that's what you're intended to do. In Texas, if you bring up an affirmative defense in one of these shotgun pleadings, though, even if you never do elaborate on it, the other side is presumed to have had to prepare to address it and can ask for costs and fees for doing so if it proves to be nonsensical or frivolous.

That isn't how this works. That isn't how any of this works.

Ron has claimed hundreds of victims. He has claimed Vic is a serial rapist. He has to prove that, not that Vic might have hugged someone once or eaten a jellybean.

Ok so removing the TCPA thing for a bit, can Casey still amend his defense now after submitting his response? Like could he go oops we forgot to add this defense and amend his answer, like the agent thing?

It's really for Funi to argue that Ron wasn't their agent. They're the ones who need to defend against liability on that claim.

Casey filed a lot of boilerplate defences, most of which aren't even going to be relevant. It's hard to see what they could add as they literally seem to have just cut and pasted every available affirmative defence to the plaintiff's claims. It's still extremely early in the legal process, so I wouldn't be surprised if Texas does allow amendments at this point.
 
Jeez, Shane is talking a lot about Ron. With that last statement about Monica not knowing what he was doing, it could either be A. He's gonna throw SoyBoy under the bus or B. He's trying to keep Ron out of a civil conspiracy claim. I'm thinking B. In fact, I don't think Ron's a cuck. I think he's cucking Monica with Shane. That poor chair unfortunately ends up getting pulled into a 3 way with them.

He's trying to act "unbiased" but is blatantly trying to excuse the actions of Moronica and Co.

1) not all of the defendants need to be found guilty of civil conspiracy

2) while Monica may have been unaware of Ron sending that particular series of texts, she was presumably aware that her (actual) agent was contacting other cons regarding Vic. Discovery will reveal whether she communicated to other VAs/defendants about what she was doing

I don't even think he's trying to do that. I think he's just trying to keep up the negative narrative which it would be unwise for the defendants themselves to continue at this point.
