The problem with the rope-a-dope is that it'll have to deplete Meyers cash reserves before his own. Google says he's worth $4m, but it's notoriously unreliable. From what we've seen it looks like Waid has a bunch of his net worth tied up in items that are hard to liquidate (house and nerd collectibles) and he might not be able to wait for best offers if it gets to that point. Waid has a steady job, but I'm not sure if Marvel is putting him on anything that could pay highest rates. His current book at issue #2 sold less copies at $4 to stores than YBZ's $20 book to customers. Waid lives in a more expensive area and likely has high living expenses, YBZ is rooming with his army mate and is notoriously cheap due to prior poverty. YBZ does have child support but was able to show he was in ahead of payments before(?) any of the IGG books were being sold. In the last year and change YBZ has made ~500k+ profit* from his IGG and has ~50k more in the GFM compared to Waid. Waid's star is fading while Meyer's is rising so IMO it's not a good strategy.
*YBZ showed ~850k sales in a recent video. I'll put 500k as a lowball estimate as this assumes he massively fucked up and overpaid for everything. My guess is that he is somewhere in the 650-700k profit range.

He can take it up to the Fifth Circuit but at this point, it won't stay the case. It also has about zero chance of success, much as with the current repetitive motion to dismiss that is predicated entirely on arguments already rejected once by the court.

Who is Wade more likely to listen to: His attorneys or his followers on twitter? They have built up this case so much that Wade's reputation as the internet avenger is on the line here, and besides his toys what else does he have?
I've noticed that twitter is focused on the libel and ignoring the TI. I could see a settlement where the libel claim is dropped in return for a settlement on the TI. This would allow everyone on twitter to claim a 100% total victory and avoids a costly court battle. Meyer gets some cash and a non-disparagement agreement. Wade keeps his toys and avoids a loss. I'm sure that twitter speds like Doyle would welcome a precedent that allows them to libel anyone online with no repercussions.

What they also dont realize is that it's highly unlikely for a judge to toss it out in pre trial. All the legal and definitional disputes are matters of law and facts that need to be decided by a jury. Meyer has made a clear case he has potentially been defamed. Whether or not the Jury agrees is another matter. But the charge is going to be considered at this point.
