It procedurally makes perfect sense. The deadline for otherwise filing this would expire before the decision about jurisdiction, which is obviously the first thing to decide.

So without an extension, it wouldn't be possible to raise the TCPA issues.

Now, frankly, those issues are absolutely frivolous bullshit.

But procedurally this makes perfect sense.

My layperson's bet: They try for the commercial speech exemption, either misstating it or arguing for broadening it, and they fail.

I think they take a kitchen sink approach and claim everything, because Mark Zaid is just that much of a complete shithead.

We're long away from that. He hasn't filed anything yet other than a marginally meritorious personal jurisdiction motion.

I think Zaid is stringing Waid along, telling him that all these delays are good for his case. Once Waid runs out of money, Zaid is going to make up some lame excuse, leave all the work to the Texas lawyers, and flounce with Marky Mark's cash.

Delays are good if you have no defense.

The more delays you get, the more it's likely that the plaintiff just says fuck it and goes away.

IE The Defendant cannot bankrupt themselves via appeals thus depriving the Plaintiff of the judgement? Or as we like to think of it, the "Poison Pill that Killed Gawker".

Yes, Texas has supersedeas bonds.
 
If Meyers lawyer is working on contingency doesnt that make that unlikely?

We don't know what conditions Meyer's lawyer is working under.

What we do know, though, is he has as much money as he needs. That dude is funded.

It's not a bad strategy, I suppose. If they keep Meyer waiting for long enough, he might eventually run out of mon- oh wait

That strategy sure seemed to make more sense before the cavalry showed up, didn't it?

If Waid stalls this long enough for Meyer's funding to get low I'd definitely toss some money at another GFM simply on the basis that this has been highly entertaining and I don't want to get off this train yet.
