How or why? Zaid can do things that benefit a friends business or his own so long as they don’t inflict direct harm on others. The only major question regarding Zaid knowing the store owner is it clearly indicates he was aware of the store and it’s location. It also makes it likely or at least reasonable to ask if Zaid was awRe of Waid’s event at the store earlier this year, given the direct triangle of relations between Waid, Zaid and the store. Did Zaid get the Stores regular bulletins and announcements? Did he get one about the Mark Waid book signing? If he was aware of that book signing why did he allow his client to file claims before the court that he conducted no business in Texas in order to challenge the Jurisdiction? As the Lawyer you are not supposed to sign off on the filing when you know your client is lying in his afadavit.
Hmm I wonder if we could dig up any flyers on that.

And yes to clarify the people contacted at other jobs bit. The owner of AP is a practicing Physician. Waid hunted down the business number for his Medical Practice and called him there. Probably not of any real legal value beyond the basic fact that it is nearly impossible to find the phone number for a Medical Practice or Physician without discovering the State or locality it is in. Waid didn’t call the Doctors cell phone. He called in through the MD office receptionist. There is no way he was not aware that it was a Texas business.

I don’t know if it rises to malice. But it surely illustrates intent to directly influence the parties and interfere with the contract. This isn’t just Waid being sued for railing at AP’s public facing communications channels. He took deliberate and outside the norm steps to directly and personally contact AP’s owner via non AP channels. If nothing else that out of bandwidth phone call can likely be used to counter Zaid’s most recent “slap” filing.

As Nicky Rackets has pointed out, even in Internet lawyering, the comics "pros" are easily one of the dumbest, blindest group of idiots ever gathered together on one side of a legal cause since sovereign citizens. You can be certain that when Waid loses these dumb motions they will be raging hard about corrupt, biased judges and all kinds of similar whiny ass bullshit instead of facing the fact that their boy done goofed.

The bar is extremely low for being declared legally insane; you have to expressly show you have no understanding whatsoever for it to even have a shot. Waid the dummy though shows some understanding of this, meaning he's fucked.
 
Civil law is all about correcting damage caused to someone. Nobody is going to jail for it so insanity is not a defense. The only defense an insane person has in civil court is if they are so nutbars they have a legal guardian over them. In which case the guardian can be sued instead.

Let's say all of this happens and it is found that there is conversations between the two, could you then argue for discovery of conversations between fake Christmas and Mags? Or would that go into another lawsuit?

I guess it depends how much they want to spend. There's already talk of discovery over the jurisdictional bullshit so it would make sense to do this other stuff at the same time.

It doesn't seem terribly likely it's worth suing a worthless troon like Brian Visaggio, who probably doesn't have a pot to piss in.

Couldn't he use this as further fuel of tort interference from Waid though? Does RICO apply for civil suits?

Nope. That’s a defense in a criminal matter. There is no “guilty/not guilty” in a civil matter. Even if Waid is shown to be batshit insane, he is still responsible for the damage he does. His assets still get attached. And if he is so nuts that a guardian has been declared, then that guardian has the responsibility.
