If Meyer prevails, the REEEEEing will be all about what a racist asshole state Texas is, and not one of them -- not one -- will demonstrate the faintest understanding of what tortious interference or why this was such an egregious example of it.

It is such a textbook example that I would not be shocked in the least to see it in an actual textbook if there's ever a published opinion about it.

Yeah, @AnOminous was right to begin with. Usually is.

It's literally something that could show up on a Torts final. All that's missing is Meyer slipping on a banana peel on his way home from the printer and Waid getting into a Rube Goldberg-esque car accident that causes multiple injuries from different sources.

Oh, to be a fly on the wall in the events leading to this amendment.
"I forgot that I defamed him" is such a canard. "There's video? Oh, shit." is probably a better explanation. I don't see this making him look much better as a uneducated member of the peanut gallery, aside from correcting his perjury.

I think this is Zaid covering his own ass, frankly. I think Waid lied to him and Zaid didn't hear it until he heard it from Meyer's counsel. He might have seen it on Twitter and just disregarded it because of zealotry but when it was clear that his client was lying, had done it on video, and that he had filed a motion relying on his client's perjury, he was in deep shit if he didn't fix it immediately.

Also the docket is updated again.

ORDER GRANTING 11 Unopposed Motion to Extend Time to Respond to Defendant's Motion to Dismiss. Signed by Judge Lee Yeakel. (lt) (Entered: 11/16/2018)

That was quick.

Waid has just filed a "supplemental declaration" letting the court know that he just now "remembered" that he had in fact been physically present in Texas talking about Meyer during the period he said he was doing no business in Texas.

He cites https://www.youtube.com/watch?v=AbLVYvXnwp0 from 18:50 on.

Honest Injun he just totally forgot. Just slipped his mind.
"There is no jurisdiction in Texas, I never did business there...oh wait... I was there".
Already any judge who looks at this is not going to have a good impression of them. I'm guessing this blows the jurisdictional argument out of the water, as many have already told the ghost-chasing lawyer.

Hope people on twitter point out to Zaid that he has been a massive cunt on twitter for weeks denying this, and that he suddenly has accepted what "the nazis" have been telling him as true. Either he will shut the fuck up, or REEEEEEEEE, I hope the latter.

I’m dumb, please explain.

Is it bad for Waid that hes been forced to enter evidence that he defamed Meyer? Does this potentially mean the defamation part of the suite cant be dismissed so easily?

Well, duh. Can you imagine a situation where it would be good for you to be forced to admit you previously committed perjury?

About the only "advantage" for Waid here is that since he's confessed to his perjury, there is no compelling need for him to be dragooned into an emergency deposition to question him in detail about his bullshit.

Its almost like saying things to a court has consequences. Unlike saying thing to comics media circle jerk and twitter. Hasn't Waid watched ANY television? The whole "can be used against you" line is common knowledge to even the most retarded.

I’m not sure it was Zaid. Waid May or may not have been bullshitting Zaid, but given Zaid’s public persona and twitter baiting .i kind of doubt it. But the Texas lawyers are the ones really on the hook for this BS. They would be the ones freaking out as they are the Texas babysitters for Waid and Zaid. And I’m sure the Super Hero And Super Lawyer are not being straight with them.

I’m dumb, please explain.

After Waid filed his motion for dismissal claiming Texas has no jurisdiction, Meyer’s people have 14 days to respond. They requested an extension to investigate since it has become clear that Waid’s filing is filled with readily provable untruths. With actual witnesses supporting that Waid lied. The Judge granted the extension and gave them another 2 weeks or so.

I’m betting that Waid’s Lawyers, Who aren’t Mark Zaid Super Lawyer, are screaming “settle this!” At him. And reasonably recommending that he not let it go to trial.

Out of curiousity how badly would that initial Bad Faith filing impact Waid at trial? Does it add to the perceptions of Malice that would prove the Defamation portion of the case? I mean in order to correct the massive perjury from the very first thing he put before the Judge, Waid has had to submit an on the record interview he did, in Texas, which heavily involved him defaming Meyer in the industry press. Am I wrong in thinking that this little snafu pretty much guaranteed the 3x damages from Defamation should the Judge rule in favor of Meyer?

Not being a mind reader I can't make absolute predictions, but if you're the defendant and your own star witness, and you got caught committing perjury with your very first statement to the court, your odds are not great.

That’s kinda what I thought. The amended filing is really to protect his Lawyers. It’s them telling the Judge “our idiot client failed to tell us critical things or outright lied about the, don’t blame us please.” The Judge is looking at Waid and going “falsus in uno, falsus in omnibus. Or rather “idiot in uno, idiot in omnibus = Super Idiot”
