No seriously, why would he want it? Waid likely has more than sufficient assets to pay any Judgement without getting into anything weird. Chances are if this goes to trial it will be low 6 figures.

The only reason I’d want it is for selling the movie rights to this comedy of errors later & making sure Waid didn’t see a dime out of it.

A comedy of this would be funny as fuck because you could really charicature Waid and the pros as this cartel/cabal and Meyer as a goofy dad with his wide eyed non white children.

In reading the supplemental declaration, Am I mistaken, or does it still ignore one of the core foundational untruths in Waid’s motion to dismiss? Waid claimed the Texas court has no Jurisdiction in part because he does no business in Texas. But the supplemental filing clearly shows evidence that he does? Yet he does not correct that lie. And we know Zaid is aware of it based on his doublespeak Twitter spergings in the subject. (Once again why as a Lawyer, would you do that? Why put statements out in the public space that can be used against your client? )

They're going to argue that the cons and appearances he does are infrequent and not enough to establish jurisdiction. Waid doesn't deny doing ANY business in Texas. He just doesn't admit to what he does do.

Because legal filings are public and if you knowingly submit perjury to a court and don't remedy the situation when you're informed of it, you risk disbarment or even criminal prosecution. I don't think Zaid wants to go to jail for his dumbass client.

Those are legal theories, not perjury. It's an even worse theory than it was before Mark Waid's perjury came to light, but it's not illegal to make a dumb legal argument. It isn't quite frivolous. It just isn't terribly likely to succeed.

TCPA is Texas's version of SLAPP. Mark Waid thinks a private phone call to a competitor's publisher to get them to cancel a book that would be in competition with him is protected under anti-SLAPP. That, if filed, probably will be sanctionably frivolous itself. This is just a motion to extend time since the deadline for filing this will have passed by the time Waid loses his sad jurisdiction motion that he committed perjury in.

I think they'll probably argue that Texas doesn't have specific jurisdiction because those business dealings weren't related to the complaint. Promoting your products in the forum state aren't enough.
