Details are below but the tl;dr is NF’s lawyer argues that Poppy’s answer was filed a week late and that it was also improperly filed so that it should be stricken out and summary judgment for Noehflake in the amount of $105k + fees per their June 20 request should be granted.
Noehflake’s lawyer replied to Poppy’s answer. Poppy asked for a delay because she wanted to use her business insurance to get a lawyer from
Allstate and requested a 28 day delay; NF’s lawyer never agreed to a full 28 days but did agree to stop the clock while the decision was being made.
Apparently, Poppy had 30 days to respond. When the Allstate request was made 25 days had elapsed. On June 10, Allstate notified Poppy and Noehflake’s lawyers they would not provide a lawyer. The clock began again, and Poppy had five days until June 16 (June 15 was a weekend) to file the answer.
Poppy did not file the answer until June 23. The request for summary judgment was filed on June 20.
Additionally, Poppy’s response was improperly filed. It has been argued that since Poppy is representing herself that it is likely AI generated but Poppy did not attest swear or affirm to its validity nor did she follow other New York guidelines.
This should be a lesson for everyone reading that you really REALLY need a lawyer in legal situations like this to navigate the complexities and nuances of the legal system.
Noeh seems to have a very competent and knowledgeable lawyer so this is not going to end well for Poppy. I do feel bad for Noehflake as I doubt she’ll ever see any money from Poppy, and even as of this weekend Poppy was still calling Noeh “the person who assaulted me”.
