Ah who the hell cares anyway? It's a fever dream to begin with. This company is just scrambling to find a market it can screw harder now that they're realizing there's no replacement generation coming up to replace their current aging man-baby audience.
 
I don't see any reason to doubt the patent lawyer about it, at least as far as United States law. Non-commercial fan-made creations are equal under IP laws to commercial products by corporations or professionals. Like if you draw and distribute fan art then that's infringing on someone's IP right to the concept of what you're drawing, but they can't legally use and distribute your fan art either because you still technically own the drawing you made and any original aspects thereof. A game mod requires interacting with a program whose code you don't own to work, but the original code and assets to the mod itself still belong to you as much as the game belongs to the company. It would still be its own piece of art that should count as prior art when looking to see if something's been done before.

There's not even anything to consume. They've released no good exclusives since Donkey Kong Bananza and there's not much notable on the horizon. It's looking like a dry year 1.

And there's no 3D Mario platformer. We are so in trouble for the next year. And I don't even think The Legend of Zelda will save them this time, even if rumors of an Ocarina of Time remake are true.

No 3D Mario is such a Sega move, but Nintendo can get away with it better.

This hacker group appears to be in for money and previously hit Red Hat and Amazon Web Services to ransom them. I wouldn't expect anything like that to leak out because of this attack, they're probably looking to ransom Nintendo rather than leak information to the public, and any info they have is probably boring business stuff or maybe info on in-development games rather than old material on 30 year old canceled games.

It could still be interesting, ransom groups often sell and/or leak what they got when they don't get a ransom. If it goes anything like the CDPR and Insomniac hacks, we'll be eating good.
