I think it's just an attention grab because Nintendo didn't let them do something they wanted that'd go against their plans, not surprising nobody is talking about this because once again, as Nintendo pulled the shiny keys with the Splatoon 3 date reveal and now people are talking about that as usual when Nintendo does something despite controversy.Surprised no one is talking about this, It would be interesting to see if anything unfolds or not.

I am pretty sure that stuff like NSO (or even just stuff like Virtual console, rereleases, old Virtual Console releases, etc.) means that for a lot of Nintendo's first party games they are no longer covered under those exceptions (and also wouldn't be if Nintendo's internal archive processes, which are very, very good preserve games in formats more durable than carts with watch batteries, which they do.)
