Someone being delusional doesnt mean they lack any ability to understand right from wrong. Lots of people have idiosyncratic beliefs that will not be upturned by any amount of facts. Something like 40 percent of americans believe in ghosts. Like ten percent believe in vampires. That doesnt mean they are insane and if it did there would be far far more uses of insanity defences .

as we already covered ; Insanity in US courts means an inability towards rational thought/ specifically to be able to understand right from wrong. A guy might be friends with a chick and be convinced she is into him. Everything she does gets filtered through thoughts into a conclusion that she not only wants him but wants him to take action. So he sets a date up and nearing the end of the evening forces himself on her with idea that her protests are all part of the romance.
Now yes the guy was deluded by his own self interest, bias , and perhaps even mental illness. He still wasnt insane. He knew that rape is wrong but had come up with a rationalisation of how there was (deep down) consent despite her panicked protests.
Well as far as i know in most jurisdictions in the US its entirely up to the prosecution. The prosecution can just throw their case at a wall and withdraw if they really want to. In fact plea deals are typically WHY they stack the charge list. It doesnt cost the prosecution much to tack on charges and gives easy bargaining chips. That said there is no reason they would want to suggest or accept a plea deal that took (potentially) two felonies and reduced it to an ancillary misdemeanor. Such a scenario i could only ever imagine if there was nearly zero good case on everything else and the prosecution just wanted the guy to serve SOME time out of whole ordeal.
Prosecution likely wants any plea to include the incest charge which the lawyer almost certainly would be fine agreeing to. Seeing how his ultimate goal is what would in theory be best for his client chris. Which is being thrown in a home far away from barb. All he wants is to wipe away as much risk as possible of prison time and prevent any felony pleas.
It’s even harder to claim insanity than showing you “don’t know right from wrong”; as long as you are aware of what you are doing and that there are consequences to your actions you are responsible for your actions even if you didn’t think they were wrong. Chris knew that Barb was his mother and he knew what sex was so he was aware of what he was doing. He hid her identity in his cheeky little leaks and bought a book intended to minimize harm so he understood that consequences exist for his actions.

I typed out more to that post but some of it just didn’t go through. In it, I mentioned that his insistence that “I was actually doing a good thing because I was helping her” is, ironically, proof he understands the concept that there are things that are right and things that are wrong because he knows he needs to justify his actions.

To be ngri he would, at the time of the crime, have to not understand the concept of right vs wrong at even an extremely basic level, genuinely believe that Barb was a Roseachu and not his mother or something , or not know what sex is. There’s ample evidence to disprove all of those claims.

Exactly, there is a distinction as well between full blown active psychosis NGRI and Temporary Psychosis - i.e. in a full blown active psycosis situation you have to be nearly totally disconnected from reality all the time and your crimes will have a logic to them it will be broken non nonsensical logic but one you'd be able to explain "Yes I did try and heal that man with my knife I was trying to save him from the Smuph Demons entering his body" and then there are the times where someone is just mentally broken in the moment and beats someone to death or lashes out with a knife or something and that ones far harder to prove and the perpetrator is normally insanely remorseful in such situations.

He was boastful of the crime and consciously aware that it was considered wrong by wider society but still did it not just once but a few times and tried to obscure his actions through lies and omission because he knew it was wrong.

An important point here. I'm simply describing what the description for it is.
What this means in practice and what they intend for that description isn't meant to simply be someone doesn't have any values around right or wrong. But that someone is incapable of rationalization towards it

Otherwise you'd have any number of inner city youth skating their way out of crimes while pointing to their twisted value system claiming they never really understood what they did.

This was never what an insanity defence was meant to cover and I have tried to make that as clear as possible.

It's sort of on the table. Chris is not being charged with anything and instead needs to spend a year or two in a tard home. If he cooperates he'll walk with no charges, but if he messes up then he'll get a felony incest charge as punishment.

We know he's a fucking coward - his first stay behind bars following the macing incident he's not spoken a word about but it's easy enough to infer he spent his time in a drunk tank scared out of his wits, staying quiet and to himself. It was the fact nothing happened to him during this time that made him act more beligerently after his second arrest as he thought it would just end the same way as the first; a weekend in jail and then months of court ordered therapy every so often while he stayed home and did whatever.

We also have reason to assume that he blew his top last February when he was not released to go back home after a year in jail, since the Spamton letters indicated he was pretty certain of it and wrapped it up in the idea it was the prayers of his apostles because Jesus analogies. That's what got him sent to Western State where more shit went down, leading later to the infamous second mugshot which is quite literally 'his smile and optimism: gone' if there ever was a real life example of it as compared to the original mugshot with his dopey-ass smile.

As of now, Chris has been completely cut off from basically everything for almost two years. No 14BC, no Barb, no toys, no internet based pop culture to pillage and remake in his own image (at least not nearly as much of it), and certainly not any contact with attention seeking bastards like Kengle who only indulge Chris's god complex for their own ends. It's hell for him.

What it'll come down to is how cognizant he is that this is genuinely his last chance, the autism card can't save him by default. He HAS to be on his best behavior and keep his autistic shit in check - something he's never really even bothered trying to do except maybe the Rollin and Trollin video (which ironically was the closest Chris ever has been to being a normal, socially adjusted human). He has to actually learn to keep it all in check for a year and maybe he'll get a supervised release (since he's never going to be allowed to see Barb again and 14BC probably will at least be put back on the housing market this time next year). Otherwise, it's the happy farm and the men in the nice white coats and he'll disappear into some mental hospital never to be seen again.

Given Chris' history of stubbornness, you'd be right on the money. And it stems from Chris' upbringing. It would be kind of funny if Borb disciplined their 25 year old son from not doing stupid shit, but years of spoiling and pandering to Chris' worst inclinations and habits made Chris entitled; he shouldn't be beholden to any laws because he's 'special'. If he's too old to learn how to have proper boundaries and abide the law, then it's too late for him.

Might as well put him isolated in the tard home so all he'll do is watch MLP reruns and somewhat draw, and babbles/shits himself into a coma. Chris cannot be trusted to be by himself or to be around others.

That's wrong though. He is definitely charged with a crime, and it is incest, and incest, by definition, involves sex with someone you're not supposed to have sex with. That's a sex crime.

That is not currently a crime that puts you on the sex offender registry, but that's a completely different issue.

Incest is by definition a sex crime.
