@AnOminous, the kid who sent him a GIF he alleges caused a seizure has a plea deal for 5 years on it. What can be done about this?

I remember when I was on Twitter, I had to press play to see a gif. Otherwise it was just a jpeg. If this guy does nothing from stopping gifs and videos from playing, it's his fault if anything happens.

Has he signed it? You generally agree not to appeal if you cop a plea, although there are some exceptions.

It's pretty harsh for posting a gif, but he was amazingly stupid enough to admit that he was deliberately doing it to cause physical harm. You have to be out of your mind to do that. What's sad about this is he may actually be guilty of the attempt even if Eichenwald is outright fucking lying about even having had a seizure.

I don't see him getting five years in front of a normal jury, though. If he has the balls he should roll the dice. The whole point of a plea deal, though, is you're agreeing to a raw deal in exchange for getting rid of the uncertainty of getting an even worse raw deal. The prosecutor only has to worry about outright losing the case.

This pretty much sucks all around. I hope Eichenwald has a seizure and dies. Not that I'm going to send him any gifs or anything.

I'd also argue the burden of proof is on Eichenwald and he needs to prove that he a) went to the hospital because of a seizure, and b) the seizure was induced by a GIF sent to him. I wouldn't know if intent to cause a seizure, or prior knowledge that Eichenwald has epilepsy, is required. The prosecution would probably say the text "you deserve a seizure for your post" demonstrates intent.

He admitted intent and from a legal perspective whether Eichenwald was lying about having a seizure or not is pretty much irrelevant to the criminal charges.

Well, I'd think a failure to create the intended result would make it an inchoate crime like attempt rather than a completed offense.

Oh, I see now that the plea deal lists the charge he'd be copping to as aggravated assault. My apologies; previous news articles stated that he was being charged with "criminal cyberstalking with the intent to kill or cause bodily harm" and at the time people were still arguing as if the guy hadn't admitted intent or that was disputable, so I erroneously assumed this was a rehash of the same debate.

You're correct, I'd argue that he's pretty much indisputably guilty of an inchoate offense at this point but aggravated assault is murkier. But I suppose the whole point of a plea deal is that it involves admitting to certain facts that would otherwise be under contention.
