'Empire' star Jussie Smollett attacked in possible hate crime

Empire" actor Jussie Smollett was attacked in the early morning hours on Tuesday in what Chicago police are calling a possible hate crime.

Smollett was attacked by two people "yelling out racial and homophobic slurs" and "poured an unknown chemical substance on the victim," police said.

According to police, one of Smollett's alleged attackers also put a rope around his neck. Both fled the scene.

Smollett took himself to Northwestern Hospital and "is in good condition," police told CNN.

Later Tuesday, CNN's Don Lemon spoke to Smollett and a mutual friend who was at the hospital with the actor. Smollett confirmed the incident took place.

He was shaken and angry that an attack like this could happen. Smollett told CNN he fought back at the attackers.

"Given the severity of the allegations, we are taking this investigation very seriously and treating it as a possible hate crime," the police statement said.

Smollett has starred on Fox's "Empire" since 2015. He plays Jamal, a successful singer in the musical Lyon family. Like his character, Smollett identifies as gay.

"We are deeply saddened and outraged to learn that a member of our 'Empire' family, Jussie Smollett, was viciously attacked last night," a representative of 20th Century Fox Television and Fox Entertainment said in a statement to CNN. "We send our love to Jussie, who is resilient and strong, and we will work with law enforcement to bring these perpetrators to justice. The entire studio, network and production stands united in the face of any despicable act of violence and hate -- and especially against one of our own."

A representative for GLAAD told CNN the organization has reached out Smollett to offer assistance and support.

"Jussie is a true champion for LGBTQ people and is beloved by the community and allies around the world," a GLAAD spokesperson said in a statement.

In either case, it's not his call and I couldn't see anything that suggested it wasn't just the judge's personal decision. Which might mean the judge wants to give him a slap on the wrist and doesn't want a tonne of people seeing that he shouldn't when they watch the actual evidence. Or maybe the judge just dislikes televised trials. I don't know how to find out who the judge is in this case.
Very few courts allow cameras by default, and many outright prohibit it. Even where it is allowed, most judges don't like it and won't allow it. It creates a circus atmosphere and in some cases, even completely derails the trial leading to terrible results, look at O.J. with a star-struck judge who let the defense team get away with murder while also letting O.J. get away with murder.

The Rittenhouse case is a rare example of where it was actually a good idea because of the sheer level of disinformation and outright lies being spread by the media. This is an exception, though.
 
So he just entered the court room and jury selection has begun. Unlike Ghislaine Maxwell it's not a federal crime so they're allowed to do TV coverage from inside, I think. Just had footage of him exiting the car and going in - hopefully we get more. Maybe with him being a (3rd rate) celebrity it wont get buried so hard.


As to whether he gets a slap on the wrist, well... he has Obama connections does he not but this is a Felony charge and a big deal. We got this huge circus when Kyle Rittenhouse killed two people in self-defence. If Smollet had actually pulled this off there would be twenty times that number of deaths because he almost certainly would have kicked off major race riots.

He's apparently sticking the oh-so-plausible original story of two Maga hat wearing Yetis roaming through the Chicago winter in search of gay Black actors to terrorise.

Chicago police / prosecution (not sure which) also making the claim that his motivation was to further his career. Personally, given close ties with DA and Dem leaders and timing, pretty sure his main goal was political agenda.

He burned all of those connections hard when it came to the original prosecution. Kim Foxx dropped that case so hard and so fast the usual Chicago suspects never got the expected cut in order to make it go away. So he'll need to pay up with interest now.
 
As well as Kim Foxx not being on call as a witness Smollett's lawyer also cannot question the brothers directly. I believe it was something to do with him already having been in contact with them outside of official channels.

While I know it's done little to sway the devout a lot of people I know were astounded by the Rittenhouse stuff during the trial so it may on balance have been the right call.

Jussie Smollett hatched a "secret plan" to concoct a hoax hate crime against himself, a court has heard on the opening day of the US TV actor's trial.
Mr Smollett, 39, told police in January 2019 that he was attacked by two men who shouted pro-Trump slogans and tied a noose around his neck.
But his defence lawyers told the trial their client was "a real victim".
Mr Smollett has denied wrongdoing. Fifteen jurors were chosen earlier on Monday to hear the case.
Authorities allege that Mr Smollett paid two Nigerian-born brothers $3,500 (£2,630) to carry out the attack to promote his career because he was "dissatisfied with his salary" on the TV show Empire, which is about a hip hop dynasty.
Mr Smollett has claimed the payment was for one of the brothers to work as a personal trainer.
The actor - who was written out of Empire amid the fall-out from the alleged hate crime hoax - was indicted by a special prosecutor in Illinois last year on six counts of lying to police.
During opening arguments on Monday, special prosecutor Dan Webb argued that the actor had "developed a secret plan that would make it appear that there was actually a hate crime that actually occurred against him by supporters of Donald Trump".

He said he conducted a "dress rehearsal" with the two brothers, and directed them to shout racist and homophobic slurs at him, the Chicago Tribune reported.
"He told them to use a rope to make it look like a hate crime," Mr Webb told the court.
The two brothers accused of carrying out the attack - Abimbola and Olabinjo Osundairo - are both expected to take the witness stand. Both men had worked as extras on Empire.
Mr Smollett's defence lawyer, Nenye Uche, denied the prosecutor's arguments, saying that his client "is a real victim" of a "real crime", according to AP News.
In court, Mr Smollett's lawyer argued that the brothers attacked the actor because they did not like him. He also suggested that a third attacker was involved.
Mr Smollett arrived in court flanked by supporters and wearing a black face mask.
Previous disorderly conduct charges against him had been dropped following an emergency court appearance in March 2019, prompting Chicago police and the city's mayor to accuse courts of letting Mr Smollett "off scot-free".
Mr Webb was later assigned to investigate how the case was handled. He announced that his office had obtained "sufficient factual evidence" to argue that the case should not have been dropped.

In a statement before the trial began, Mr Webb said that prosecuting the case was "in the interest of justice", partly due to the "extensive nature of Mr Smollett's false police reports" and the resources expended by Chicago police to investigate.
If convicted, Mr Smollett faces a prison sentence of up to three years. Given Mr Smollett's lack of previous convictions, however, legal experts have said a lighter sentence or probation is more likely.
It remains unclear if Mr Smollett will testify during the trial, which is expected to last a week.
Ever since authorities cast doubt on his claims, Mr Smollett has repeatedly maintained his innocence.
In an Instagram Live interview with US author Marc Lamont Hill last year, Mr Smollett said that the last two years had been "beyond frustrating".
"They won't let this go…there is an example being made," he said. "The sad part is it's an example being made of someone that didn't do what they're being accused of."
US Vice-President Kamala Harris had called the purported hate crime at the time "an attempted modern day lynching".
While this doesn't cover everything, the third man claim seems to have been come about because a single person in the witnesses the police looked into claimed to have seen a white man who might have been carrying a rope.

If course given Smollett only mentioned two attackers initially that's going to look suspect to a jury but hey, who knows how these things go.

This idea that Jussie Smollett is some oppressed victim who had to seriously make up a bad lie to slander Trump’s own voters is just proof that actors really need to work on actually being human, and not just lizard people in training.

It also doesn’t help that when bodycam footage showed Jussie showing cops what the noose looked like, it literally looked he just randomly stashed this in his home closet somewhere and was just waiting with it in his hand.

He didn’t even look like he was in any harm, let alone in real danger.

Didn't at least one of the two guys involved admit that was how they met him in the first place?
 
Not a whole lot of excitement, attempt to claim the police immediately rushed to the conclusion that he faked it, confirmation that Smollett refused to hand over hospital records for his visit there (I'd love to know what the hospital thought of him) or provide a cheek swab for comparison to the DNA on the rope and Smollett's brother claiming to the press that his brother has always told a completely accurate and true story.


The lead investigator of an alleged attack on the actor Jussie Smollett on Tuesday denied claims by defense attorneys that Chicago police rushed to judgment, saying about two dozen detectives clocked some 3,000 hours on what they thought was a “horrible hate crime” before concluding the former Empire star had staged a hoax.

Taking the stand as prosecutors began their case, former Chicago police detective Michael Theis said he initially viewed Smollett as a victim of a homophobic and racist attack and that his team “absolutely” did not rush to judgment.

Theis said investigators spent days after Smollett reported the alleged attack in January 2019 following up leads, collecting videos from surveillance cameras, door bells and businesses, poring over phone records and canvassing the area in sub-zero temperatures.

He also said Smollett refused to provide medical records related to the attack or a cheek swab so investigators could compare it to DNA that may have been on a rope Smollett said the attackers put around his neck.


“At the end of the investigation, we determined that the alleged hate crime was actually a staged event,” Theis said.

In opening statements on Monday, defense attorney Nenye Uche said two brothers attacked Smollett because they did not like him and that a $3,500 check the actor paid the men was for training so he could prepare for a music video.

Uche also suggested a third attacker was involved and told jurors there was not a “shred” of evidence linking Smollett to the crime prosecutors allege.

“Jussie Smollett is a real victim,” Uche said of the actor, who is Black and gay.

Smollett is charged with felony disorderly conduct, which carries a prison sentence of up to three years.

According to special prosecutor Dan Webb, Smollett recruited the brothers to help him carry out a fake attack which he reported to Chicago police, saying he was attacked by supporters of the then president, Donald Trump.

“When he reported the fake hate crime, that was a real crime,” Webb said.

Chicago police have said Smollett claimed he was attacked because he was “dissatisfied with his salary” on Empire.

He “took advantage of the pain and anger of racism to promote his career”, said the then Chicago police superintendent, Eddie Johnson, adding: “This publicity stunt was a scar that Chicago didn’t earn and certainly didn’t deserve.”

The allegedly staged attack on Smollett drew widespread reaction and excited political and ideological divisions across the US.

Kamala Harris, then a California senator, condemned the attack as an “attempted modern-day lynching”. The actor Viola Davis wrote: “We all have to take this racist and homophobic act of violence very personally.”

Trump tweeted: “Jussie Smollett – what about … the tens of millions of people you insulted with your racist and dangerous comments!?”

Outside the courtroom on Tuesday, Smollett’s brother said it has been “incredibly painful” for the family to watch Smollett be accused of something he “did not do”.

“We’re confident in his legal team, and we look forward to people hearing the actual facts of this case,” Jojo Smollett told reporters.

I believe the two Nigerians were pay-for-gay with him. Jussie loves the BBC in his bussy, and that level of shameless, desperate faggotry no black American will ever get near means opportunity for a pair of struggling immigrants of color. So yes, I fully believe there was kinky rope play involved given what a broken buck he is.

But as to the noose itself, it was actually some clothesline he bought with a credit card (no, didn't even do the most basic thing of paying cash for an item like that) right before the "attack" happened.
 
Prosecution has rested and Smollett's lawyer is trying to claim the judge is threatening them. Is this what comes when even pounding the table is out?
(CNN)Two brothers testified in court over the past two days that "Empire" actor Jussie Smollett directed them to carry out a fake hate crime while pretending to be Donald Trump supporters in an attempt to get media attention.
Abimbola "Bola" Osundairo and his brother Olabinjo "Ola" Osundairo provided critical testimony on Wednesday and Thursday in Smollett's criminal trial on charges that he staged the attack and falsely reported it to police.
The prosecution rested Thursday evening after three days of testimony in which it called seven witnesses, including the brothers.
Ola Osundairo told jurors that Smollett "had this crazy idea of having two MAGA supporters attack him," and that he wanted "to put that on social media."
"Mr. Smollett asked you to fake attack him?" Deputy Special Prosecutor Sam Mendenhall asked.
"Yes," Ola Osundairo responded.
"Pretending to be Trump supporters?" Mendenhall continued.
"Yes," Ola Osundairo said.
"So he could then post it on social media?" the prosecutor continued.
"Yes," Ola Osundairo answered.

He said that Bola was tasked with hitting Smollett, while Smollett wanted Ola to put a noose around his neck and pour gasoline on him. They ultimately changed gasoline to bleach because, Ola Osundairo said, "I wasn't comfortable pouring gasoline on somebody."
Smollett, who is Black and gay, has said two men struck him, yelled anti-gay and racist remarks, put a noose around his neck and poured bleach on him on a frigid night in Chicago in January 2019. Police initially investigated the incident as a possible hate crime and poured significant resources into solving the case and locating the two men.
But after interviewing them and finding other evidence, authorities instead determined that Smollett paid the men $3,500 to stage the hate crime against him so he could get publicity and a career boost.
Smollett has pleaded not guilty to six counts of disorderly conduct for allegedly making false reports to police that he was a victim of a hate crime. His defense attorney said in opening statements he is a real victim and the men saw the actor as a "mark" or "target."
Thursday's session got heated and defense attorneys called for a mistrial. One of the lawyers alleged Judge James Linn lunged at her, and another said the judge was making facial expressions.
It began when the judge interjected as attorney Tamara Walker repeatedly pressed Ola Osundairo on his use of homophobic words, such as when he referred to a musician friend as a "fruity ass." Linn angrily instructed Walker to move on from her line of "collateral" questioning.
The defense has suggested during the trial that homophobia may have been a motive in a real hate crime attack that night.
In a heated exchange, Walker asked the judge for a sidebar, which he denied at first. After the defense for a second time requested a meeting outside of earshot of the jury, Linn sent the panel out of the room.
Walker and her defense team requested a mistrial.
As the exchange between the judge and the defense quickly escalated, Walker became emotional, at one point sobbing as she paced around a table, claiming Linn was not allowing her to continue a line of questioning that was critical to the defense's case.
Walker also claimed Linn lunged at her while at the sidebar, something Linn vehemently denied.
"When you said the word mistrial, and I know you have some pressures here, I'm stunned that you would consider a mistrial," Linn said. "Ms. Walker, there were objections that had to be sustained and I was trying to get back on point."
"Just because you think you were allowed to go one way, we're all just doing our jobs," Linn told Walker.
"There will be no mistrial," he told the stunned courtroom.
Defense attorney Heather Widell also addressed the judge, stating, "I would also like to go on the record that there are facial objections coming from the bench when there are objections."
"You're great at facial expressions," Linn shot back.
Court ended Thursday night after the defense calling its own witnesses.

Defense sharply questions Bola Osundairo​

The brothers delivered the core testimony of the case, stating plainly that the attack was always intended to be fake.
Bola Osundairo was the first of the two brothers to testify, speaking in court on Wednesday and Thursday. He told the court that Smollett "wanted me to fake beat him up," and he agreed to do so because he felt indebted to the actor.
"I believed he could help further my acting career," Osundairo testified. "He told me that we would need another person to fake beat him up. He mentioned could my brother do it. I said yes."

The actor directed them to say "Empire, f****t, n***er, MAGA," fake punch him, pour bleach on him and then run away, he testified.
"Who was in charge of this thing?" Webb asked.
"Jussie was," Bola Osundairo told the jury.
The man also said Smollett first explained the plan to him in a car where Smollett was smoking marijuana.
"Even though he's smoking you still think he's serious?" asked defense attorney Shay Allen.
"He sounded serious," Bola Osundairo responded.
Osundairo said Smollett "wanted to use the fake attack or camera footage for media." He testified that while he didn't expect payment for helping Smollett stage the attack, the actor still gave him a check for $3,500.
In cross-examination, Allen accused Bola Osundairo of having a desire to work security for Smollett and that it became a growing point of tension. Osundairo testified he didn't remember.
"You attacked Jussie because you wanted to scare him into hiring you," accused Allen, to which Osundairo responded, "No."

However, special prosecutor Dan Webb asked whether Smollett ever talked about security at all while this "fake attack" was being hatched and Osundairo responded, "No."
Testimony grew tense at times as Allen asked whether Bola Osundairo had a sexual relationship with Smollett, which he denied, and how he could not have expected the police to get involved if the media attention on the story grew, as Smollett allegedly planned.
"I wasn't thinking," Bola Osundairo said.
"We finally agree on something," Allen responded.
During re-direct examination, Webb honed in on the timing of the alleged hoax on one of the coldest nights in Chicago. "If you had not had advanced discussions with Jussie Smollett how would you know where he would be at 2 a.m. in a polar vortex?"
"I wouldn't," Osundairo responded.
Later, Ola Osundairo testified the brothers had at one point contemplated leaving if the actor didn't show up.
"It was super cold that night. I was freezing the whole time we were out there," he said. "My brother saw him and that's when we continued to approach him."
Osundairo said that's when he put the rope over Smollett's head and poured bleach on him, while trying not to get bleach on Smollett's face to avoid injuring the actor.

Defense witness says Smollett sounded panicked​

The first witness called by the defense described what he heard as he talked to Smollett during the encounter.
Brandon Moore, Smollett's former music manager, said he heard "something something MAGA country," then what sounded like scuffling.
"Jussie said, 'Yo, I just got jumped,' " Moore told the court.
Smollett sounded panicked and out of breath, Moore testified.
During cross-examination, deputy special prosecutor Sean Wieber pointed out, "You couldn't see how hard the punches landed," and "you did not witness what happened to Mr. Smollett," to which Moore responded, "Correct."
The defense also called an emergency medicine physician who examined Smollett after the alleged attack and Smollett's publicist at the time, Pamela Sharp.
The prosecution said in its opening statement that Smollett orchestrated the attack for publicity and a career boost. Sharp testified that Smollett earned between $100,000 and $125,000 per episode -- about $2 million for a season.
The judge ended the day by telling jurors not to come back until Monday, when they might hear closing arguments and begin deliberating.
Looks like we might get a result next week. I'm still thinking guilty and a slap on the wrist but juries can be stupid.

That was my first thought, he was doing some kind of BDSM thing, got caught in public high on party drugs and still wearing his noose, and had to come up with a cover story. The bleach thing was him misinterpreting "bleaching," a reference to a white man having sex with a black person. Even if the whole thing was a fake hate crime, I still think he got the bleaching idea from something a white top said while pozzing his neghole.

Truly amazing reading about his laywer sobbing because of the big bad judge, and then asking for a mistrail because... the judge lunged at them and was making facial expressions when they would object.

I think Jussie hired drama queens capable of outshining him. He must be seething right now.

Duh, he's an actor, actors are some of the dumbest people on the planet as they could only find employment by playing pretend and looking good. And a steady stream of assistants and underlings providing for their every need leaves them incapable of even basic problem-solving or thinking any action they take has any consequence since all you have to do is yell "CUT" and it doesn't matter anymore..... the highest "adult" level these people can ever evolve to is collegiate-tier fratboy. The narcissism of youth, usually destroyed by the adult consequences for such, never gets weeded out of them.

So, a man-child only paid to preen for a camera suffers from Dunning-Kruger Effect? Say it ain't so!

He has to hope for acquittal, otherwise, his career is over (well, terminally over, right now, it's still alive and will be alive no matter what due to people willing to hire him for woke points, but any dream he had of making the jump to "A" list entertainment is as choked dead as he pretended to be.)

He fucking can't even try that, the charges against him are strict liability with no affirmative defense. I mean, he could say that if he wants, but we're at trial already. Confessing to all the elements of the crime means that there would be element of dispute, therefor no need for a jury decision, as in the judge can just direct the verdict right then and there. The time to do that, if you were going to, would have been immediately - but now he's trapped in the lie. Being proven a liar is probably the death blow to his career, but if he gets tagged with a felony he won't be able to easily travel to shoot locations in Canada or other countries, any scenes with firearms become convoluted legally, and a whole host of other problems with media production arise that simply are not worth dealing with for a D-list talent like Jussie.

I get that they are desperate to try to label this as a homophobic act but they're trying to do that while also claiming one brother wanted a job as his security. They're not making genuine points here and that they would then try to fucking cry and accuse the judge of lunging at them made me do a double take.

Problem is he's not like these dumbass students that do that sort of thing whose name the university refuses to give up the names of. People know who he is and he has done big public performances about what happened to him, he cannot backtrack and expect people to forget.

Even if he is found guilty go look at the internet after the Rittenhouse verdict. The amount of people who just sulked and refused to accept it because it's not their outcome shows that there are plenty that will ignore Smollett's guilt as long as he continues to deny it. Admitting he faked it would burn up the few believers he still has and those still willing to give someone they know deep down is lying credit.

Also I think he was certain he was getting off. The judge tossed a motion to dismiss as recently as October and his political pals should all be in a position to get the charges dismissed like they did before. The idea that he might be found guilty has not come to his mind yet.
