Empire" actor Jussie Smollett was attacked in the early morning hours on Tuesday in what Chicago police are calling a possible hate crime.

Smollett was attacked by two people "yelling out racial and homophobic slurs" and "poured an unknown chemical substance on the victim," police said.

According to police, one of Smollett's alleged attackers also put a rope around his neck. Both fled the scene.

Smollett took himself to Northwestern Hospital and "is in good condition," police told CNN.

Later Tuesday, CNN's Don Lemon spoke to Smollett and a mutual friend who was at the hospital with the actor. Smollett confirmed the incident took place.

He was shaken and angry that an attack like this could happen. Smollett told CNN he fought back at the attackers.

"Given the severity of the allegations, we are taking this investigation very seriously and treating it as a possible hate crime," the police statement said.

Smollett has starred on Fox's "Empire" since 2015. He plays Jamal, a successful singer in the musical Lyon family. Like his character, Smollett identifies as gay.

"We are deeply saddened and outraged to learn that a member of our 'Empire' family, Jussie Smollett, was viciously attacked last night," a representative of 20th Century Fox Television and Fox Entertainment said in a statement to CNN. "We send our love to Jussie, who is resilient and strong, and we will work with law enforcement to bring these perpetrators to justice. The entire studio, network and production stands united in the face of any despicable act of violence and hate -- and especially against one of our own."

A representative for GLAAD told CNN the organization has reached out Smollett to offer assistance and support.

"Jussie is a true champion for LGBTQ people and is beloved by the community and allies around the world," a GLAAD spokesperson said in a statement.

The idiots double jeopardy claim has been tossed.

(there's not much to the article other than the claim being tossed and a recap)

For there to be double jeopardy, there has to be jeopardy in the first place. Jeopardy does not attach until you are in danger of actually being convicted of something. It's not always a bright line, but things like a jury being empaneled, witnesses testifying, a plea bargain, or other legal proceedings beyond the preliminary stages are when jeopardy attaches.

None of that happened with JDS.

Maybe Jussie can start his own BLM, Black Liars Matter.

I wonder if Jussie is jealous of all the attention George Floyd and his family got. That should have been him damn it.

In this time of deeply divided people on black and white issues, we can all come together as one as we laugh at jussie and his neverending bullshit.. It something we can all agree on and both sides would happy beat the fuck out of a jussie pinata. I think jussie has some left over rope that hecaan let us borrow to hang the pinata.

The brothers who claim they were paid by “Empire” actor Jussie Smollett to stage a racist, homophobic attack against him have now stated they are unwilling to testify against him.

Brothers Abel and Ola Osundario were thrust into the public eye in 2019 when they told the police that the actor had paid them $3,500 to jump him on a Chicago street in an effort to raise his profile because he was unhappy with his role on the Fox drama.

The brothers had originally been cooperating with law enforcement as it tried to determine whether or not Smollett faked the ordeal. They were on board to testify against the “Empire” actor but they’ve now changed their mind due in part to how police are handling evidence seized from their home more than a year ago.

Their attorney, Gloria Schmidt Rodriguez, told CBS 2 in Chicago that the Osundario brothers have changed their mind because they feel the Chicago Police Department is withholding some of the items seized from their home in a Feb. 2019 raid that was executed while they were still suspects. However, the duo claims they are still being treated like suspects and that items seized in the raid are still being kept from them.

“It’s been over a year and they need to give us our stuff back,” Abel Osundairo told the outlet.

He added: “I would understand if we were defendants in the case, which we are not.”

Reportedly among the items seized during that raid was a 9mm gun and ammunition that Abel owned legally.

Abel filed a police report and the brothers are allegedly in an administrative dispute with the police department to try and secure their property. CBS 2 confirmed that Chicago police are still in possession of the weapon, which is being preserved as evidence. Police said they will comply with a judge’s order to turn over any evidence.

Schmidt Rodriguez’s office did not immediately respond to Fox News’ request for comment.

Smollett. 37, was initially accused by Cook County prosecutors of falsely reporting to police that the alleged phony attack was real. Sixteen counts of disorderly conduct originally filed against him were dismissed and Cook County Circuit Judge Michael Toomin found Smollett’s first prosecution was invalid.

After another investigation by special prosecutor Dan Webb, six counts of the same charges were filed against Smollett, to which he pleaded not guilty earlier this year.

Smollett, who is black and gay, told police at the time of the alleged attack that two masked men attacked him as he was walking home in the early hours of Jan. 29, 2019. He said they made racist and homophobic insults, beat him and looped a noose around his neck before fleeing, and that at least one of his attackers was a white man who told him he was in “MAGA country,” a reference to President Trump’s campaign slogan, “Make America Great Again.”

I wonder what Juicy or a BLM rep offered these guys to shut up.

I mean it sucks that the cops still have some of the brother's items, but you know, it's evidence for a criminal trial. They can't just give those back to them because if it leaves police custody during a trial, that evidence would then be invalid.

I'm not a lawyer or anything, I'm just another dumb fuck on the internet, but even I know this. The brothers are just gonna have to deal with Jussie's mess, like everyone else is.

the duo claims they are still being treated like suspects
I wonder if they know that being accomplices to a conspiracy to commit a felony is also a crime in and of itself...

I think once they realized they weren't going to be prosecuted for aiding in the hoax they decided to stop helping the prosecution. They likely sympathize with whatever bullshit Smollett is trying to stoke
Maybe they don't want to get cancelled for being involved in the prosecution of a fellow darkie?

They should probably just go ahead and prosecute them, too.
