'Empire' star Jussie Smollett attacked in possible hate crime

Empire" actor Jussie Smollett was attacked in the early morning hours on Tuesday in what Chicago police are calling a possible hate crime.

Smollett was attacked by two people "yelling out racial and homophobic slurs" and "poured an unknown chemical substance on the victim," police said.

According to police, one of Smollett's alleged attackers also put a rope around his neck. Both fled the scene.

Smollett took himself to Northwestern Hospital and "is in good condition," police told CNN.

Later Tuesday, CNN's Don Lemon spoke to Smollett and a mutual friend who was at the hospital with the actor. Smollett confirmed the incident took place.

He was shaken and angry that an attack like this could happen. Smollett told CNN he fought back at the attackers.

"Given the severity of the allegations, we are taking this investigation very seriously and treating it as a possible hate crime," the police statement said.

Smollett has starred on Fox's "Empire" since 2015. He plays Jamal, a successful singer in the musical Lyon family. Like his character, Smollett identifies as gay.

"We are deeply saddened and outraged to learn that a member of our 'Empire' family, Jussie Smollett, was viciously attacked last night," a representative of 20th Century Fox Television and Fox Entertainment said in a statement to CNN. "We send our love to Jussie, who is resilient and strong, and we will work with law enforcement to bring these perpetrators to justice. The entire studio, network and production stands united in the face of any despicable act of violence and hate -- and especially against one of our own."

A representative for GLAAD told CNN the organization has reached out Smollett to offer assistance and support.

"Jussie is a true champion for LGBTQ people and is beloved by the community and allies around the world," a GLAAD spokesperson said in a statement.

I think another part of the problem is that they pissed Rham Emmanuel off. This is not a guy who plays nice. I have no doubt he's going to cut some kneecaps, because this makes him and his PD look bad. So I think there's going to be a lot of corrupt under the table shit we're not going to see. Seems to be much like if you are rich the only thing that is going to get you in jail is pissing other rich people off, well if you are corrupt and you piss off someone else shoulder-deep in corruption you best be looking back over your shoulder at all times.

Cook County State's Attorney Kim Foxx says her office treated accused celebrity hate crime faker Jussie Smollett in the same way that ordinary citizens facing similar criminal charges are treated.

Is that true? Not so much, according to court files that document what has happened to other defendants who've allegedly filed run-of-the-mill false reports with Chicago police. CWBChicago today pulled Chicago Police Department and Cook County Court Clerk records to see just how comparable Smollett's case outcome is other citizens' cases.

The prosecutor who took over the Smollett case when Foxx stepped aside, Joe Magats, said Tuesday that the resolution Smollett enjoys “is available to all defendants; it's not something out of privilege; it's not something out of clout."

Foxx spokesperson Tandra Simonton claimed the Smollett resolution "is not a new or unusual practice.”

But Eric Sussman, who once served as Foxx’s top deputy, had a different take: “I’ve never, ever seen anything like this.

If Smollett's resolution "is available to all defendants" and "not a new or unusual practice," then there are a bunch of people pleading guilty and saddling themselves with lifetime criminal records for no apparent reason. Here are the details of those cases and their court dispositions:



CWBChicago researchers today located eight recent cases that align closely with Smollett’s. Like Smollett, each of these individuals had no prior adult criminal charges in Cook County. The alleged incidents took place in Chicago and were handled by Chicago police. Each defendant was charged with only one crime: a single felony count of disorderly conduct-filing a false police report (720 ILCS 5.0/26-1-A-4). Smollett was charged with sixteen counts under the same statute.

Here's what happened in those cases:

Jussie Smollett, 36
Police alleged that Smollett falsely reported being beaten, doused with bleach, and wrapped in a noose by two masked white men who yelled anti-black, anti-gay slurs while announcing “this is MAGA country.” Associates of Smollett, a TV actor, leaked the story to a well-known gossip website within 10 hours, which put a spotlight on the matter. The ensuing police investigation lasted three weeks and involved the work of at least 12 full-time detectives, according to CPD. Smollett maintains his innocence.
Days to resolution: 33
Outcome: Unknown. Court file was sealed immediately. Smollett did not plead guilty to any crime. Prosecutors said he agreed to give his $10,000 deposit bond to the city of Chicago. There is conflicting information about whether or not approximately 16 hours spent at the Rainbow PUSH Coalition on March 23rd and 25th was community service and further confusion about whether that possible service was part of the case resolution.



RR, 27, and KM, 27
Tourists RR and KM were accused of falsely reporting to Chicago police that they were robbed of $20,000 in cash and property when their GPS led them into Lower Wacker Drive.
Days to resolution: 11 months (RR), 13 months (KM)
Outcome: RR pleaded guilty and was sentenced to two-years probation, 30 hours of community service, and fined $584. KM also pleaded guilty. She was sentenced to two-years probation, five days time served, 30 hours of community service, and she was fined $447. Both will have criminal records in Cook County.



CT, 33
Chicago police allege that CT falsely reported that his Audi had been stolen with his 7-year-old daughter sleeping in the back seat. Investigators found that the story was false and CT admitted to lying after receiving his Miranda warning.
Days to resolution: 22
Outcome: CT pleaded guilty and was sentenced to one-year probation and an unknown number of community service hours. Because he was required to plead guilty, he has a criminal record.



DB, 25
Police say DB was the passenger in a vehicle they pulled over for a traffic violation. During the stop, the driver sped off and crashed into a barricade. DB jumped out of the car, ran home, changed into his Chicago Transit Authority uniform, then called 911 to report that his car—the one that had crashed into the barricade—had been carjacked at gunpoint, according to police. Arriving officers were allegedly told by DB that four men carjacked him and two of them drove away with his vehicle. When police told DB that they knew he was lying, he admitted that he was the guy in the passenger seat of the car when it crashed, according to court records.
Days to resolution: Ongoing. The case will be a year old on Friday.



JV, 53
JV reported that he had been restrained, battered, and robbed at gunpoint in the manager’s office of a restaurant that he operates. Police alleged that an investigation involving video review and witness statements revealed that no crime occurred. When confronted with the accusations, JV asked for an attorney, police said.
Days to resolution: Ongoing. The case is 50 weeks old.



CJ, 49
Police said Jacobs filed a false report for battery.
Days to resolution: 7 days
Outcome: Prosecutors reduced the charge from a felony to a misdemeanor. CJ pleaded guilty and was sentenced to one year of court supervision and 60 hours of community service. Because she was required to plead guilty, she has a criminal record.



JA, 19

Police say JA called 911, reported being robbed at gunpoint, and provided officers with a detailed description of the offender. Cops stopped a man matching the description and asked her to identify him. That’s when police learned that the “robber” was JA's boyfriend and that she called in a fake robbery because he cheated on her and she was angry, according to court records. JA further stated that she didn’t think that police would actually take her seriously.
Days to resolution: Six months.
Outcome: JA pleaded guilty and was sentenced to 24-months probation, two days time served, and fined $804. The guilty plea left JA with a criminal record.



DO, 28
Prosecutors said DO reported a false kidnapping. No further details were available in the case file. DO was arrested on the same day that the allegedly false report was made.
Days to resolution: 27 days
Outcome: Guilty plea. Sentenced to probation for a year.


Some dispositions similar to Smollett’s may be found in cases where individuals were charged with a single misdemeanor charge of a similar crime: filing a false report to a public safety agency (720 ILCS 5.0/26-1-A-5). The following cases involve individuals with no prior adult arrests in Cook County who were charged with only one misdemeanor count of false report to a public safety agency.



MA, 25

Police said MA falsely reported that he was robbed at gunpoint while taking proceeds from a restaurant that he manages to the bank.
Days to resolution: Three months
Outcome: Pleaded guilty. Sentenced to one year of court supervision.



AK, 18
Chicago police alleged AK called 911 and falsely reported that he saw a man drop a gun in a White Castle men’s room. He provided a full description of the man and said the armed offender was standing outside the restaurant, police said. AK later admitted that the report was false, according to his arrest report.
Days to resolution: Ongoing. The case is three months old.
Outcome: Deferred prosecution, 30 hours of community service. The case is pending. If community service is completed, he will not have a criminal record.



DG, 36
DG was accused of telling police that he had been battered by a group of black men who displayed a gun outside of Wrigley Field. Police said they reviewed surveillance video that showed his claim to be false.
Days to resolution: 98
Outcome: Prosecutors dropped the case after DG completed 20 hours of community service. He was not required to plead guilty. The case has not been expunged or sealed.

Unusual handling
Some other differences between Smollett's case resolution and the route taken by ordinary people are apparent. Smollett's case was concluded in an "emergency hearing" rather than at his next scheduled court date on April 17th.

According to Cook County Circuit Court guidelines, emergency motions require “sudden or unforeseen circumstances” that “rise to the [level of] emergency.” Attorneys seeking an emergency hearing are required to explain “the reason(s) the matter should take precedence.”

Particularly odd was the decision to immediately seal Smollett's court record. Even when individuals are acquitted of crimes, the court record remains accessible to the public until the individual seeks expungement—a 60- to 120-day process that entities such as the Chicago Police Department have an opportunity to contest.

But Smollett's judge yesterday immediately sealed the case, and the case was removed from clerk electronic records within four hours, barring anyone from reviewing the matter. Foxx today said the sealing was an error that would be undone. As of midday on Wednesday, Smollett's case had not returned to the clerk's system.

Looking for examples
Supervising prosecutors in Foxx's office received the following email on Wednesday afternoon, seeking help in identifying felony defendants who had received treatment similar to Smollett's. We're not sure why the email would be necessary if Smollett's handling has been "available to all defendants."

Jussie Smollett did community service at Rainbow PUSH Saturday/Monday for about 16 hours total. Charges dropped Tuesday. That along with a forfeit of his $10k bond was enough to drop the charges according to State’s Attorney.

He worked in bookstores, sold merchandise. Stuffed envelopes. Spoke to students. Talked to musical director about expanding choir. Helped in video dept and offered critique. “He was very accessible” PUSH says.

While many were still reeling Wednesday from the stunning dismissal of charges against “Empire” actor Jussie Smollett for allegedly staging a hoax hate-crime attack against himself, the Rev. Jesse Jackson defended his organization’s letter of support cited in the court case.


A letter from the Rainbow PUSH Coalition stating it had been the beneficiary of some 16 hours of on-site community service from Smollett right before the Tuesday hearing was cited by prosecutors in dropping charges, along with one from the Los Angeles-based Black Aids Institute.


Jackson, who’d explained his organization developed a relationship with Smollett back in January, reaching out to the TV actor/singer after the headline-grabbing incident, discussed that relationship, citing racial inequities in the criminal justice system as why PUSH supports Smollett.

“PUSH has always been a house of refuge. It’s part of what we do, reaching out to people who are in distress, and we have done so in many high-profile cases over the years, from Sammy Davis Jr., when he hugged President Nixon and black folks turned against him, to Bobby Rush, after police tried to kill him in the Black Panthers raid,” Jackson told the Sun-Times.


“You can’t have people just one incident away from being in oblivion.”


Jackson said after PUSH reached out, Smollett, charged with 16 felony counts in the incident, came to see Jackson. Smollett later joined Rainbow PUSH as a member and had previously volunteered there, Jackson said.


Then last week, Smollett called and asked to come and volunteer on Saturday, March 23, and Monday, March 25, said Jackson. The volunteer work was under no court mandate, said Jackson, adding he had no knowledge those 16 hours would be cited by prosecutors, who sealed all case records.


“He worked to develop our choir,” Jackson said. “He worked in our studios. He worked on production. And he worked with kids in our tech program, teaching apps and codes and robotics.”


Jackson said he supports the prosecutors’ decision.


“I’m concerned about the inconsistencies of the criminal justice system. They’re saying he got a break because he’s well-known. Well the fact of the matter is prosecutors use discretion every day. Look at the Laquan McDonald case,” Jackson said.


“Jason Van Dyke got nearly seven years for murdering him, while the teen who killed Hadiya Pendleton, got 84 years. The officers who saw McDonald murdered and lied about it got off, and still have their jobs. Look at Paul Manafort’s sentence. Prosecutors got this guy on international larceny, and he got less than four years. And look at U.S. Rep. [Aaron] Schock, who got to pay the money back and have his record cleansed, while my son [former U.S. Rep. Jesse Jackson Jr.] went to jail,” Jackson continued. “We want one set of rules.”

Soon after Jackson’s extramarital affair was revealed, Jackson announced that a convicted sex offender with strong political connections would be the Rainbow PUSH Coalition’s new consultant on prison reform. Former congressman Mel Reynolds, a Democrat from Chicago, was convicted in 1995 for having a sexual relationship with a 16-year-old girl and soliciting child pornography. Until his sentence was commuted by President Clinton, Reynolds also was in prison for bank fraud, wire fraud and lying to the Federal Election Commission about misused political contributions.

But despite Jackson’s own public scandal, Reynolds’ political connections seem to have outweighed public relations concerns. It’s not the first example of Jackson’s loyalty to the Democratic Party and his affinity for partisan politics. Some activities beg further explanation to Jackson’s donors:

The tax-exempt Citizenship Education Fund and the Rainbow PUSH Coalition spent a total of $614,419 last year for Jesse Jackson’s travels. In February, Rainbow PUSH chief financial officer Billy Owens admitted that more than $450,000 of Jackson’s travel expenses were paid by several Democratic Party committees for get-out-the-vote efforts. It is not clear what portions of the party payments went to which organizations.

A $10,000 donor to CEF was identified as the "Democratic Congress" in CEF’s 1999 report to the IRS. CEF also reported a $30,000 donation from the Democratic National Committee in 1994. The reasons for the gifts are not explained.

CEF violated the tax code if it paid for any Democratic-reimbursed travel on behalf of a candidate. That could cost CEF its tax-exempt status.

Also, it is illegal "for a corporation, nonprofit or for-profit, to spend corporate treasury funds for voter registration in behalf of a political party," Washington attorney Cleta Mitchell told the Washington Times.

A November 7, 1998 press release on the Rainbow PUSH website reported on a rally at the group’s Chicago headquarters that day. Democrats who been successful in the 1998 elections — including Rep. Bobby Rush (D-IL) and Illinois Secretary of State Jesse White — were at the rally "to return to Campaign Central and say thanks to the voters," according to the press release. It also announced a voter education drive for the 2000 elections and described a Rainbow PUSH Get Out the Vote tour, which included 64 events in 18 states prior to the 1998 elections.

"One of Rev. Jackson’s major goals on the tour was to help the Democrats regain control of the House," the release states.
Last year, Keep Hope Alive PAC reported a $5,000 contribution from a Service Employees International Union (SEIU) affiliate made in January 2000. But SEIU’s filing with the Federal Election Commission describes a much larger donation to Keep Hope Alive: $12,450 in March 2000.

The treasurer of Keep Hope Alive is Dennis Rivera, co-chairman of Rainbow PUSH and president of SEIU Local 1199 in New York City. His staff was unable to explain the discrepancy regarding SEIU’s contribution before this report was completed. Keep Hope Alive’s assistant treasurer, Katharine Boyce, did not respond to requests for an interview.

The tax-exempt CEF may not lobby or engage in political activities. But CEF and Rainbow PUSH share a web site (www.rainbowpush.org) that includes materials promoting legislation and political candidates. It is not always clear which organization is responsible for the materials.

Last year, Jackson publicly endorsed New Jersey Democrat Jon Corzine for the U.S. Senate. When pressed to release records from his family foundation, Corzine told reporters that the Jon & Joanne Corzine Foundation had granted $50,000 to the Rainbow PUSH Coalition in January 2000.

Since 1990, Keep Hope Alive PAC has made only two contributions to federal campaigns. Last year, the re-election campaign for Jesse Jackson’s son, Rep. Jesse Jackson, Jr. (D-IL), received $10,000 and Rep. Bobby Lee Rush (D-IL) received an in-kind contribution of $4,149.
In 1999, the Keep Hope Alive PAC received a $2,000 contribution from James Zogby, president of the Arab American Institute. Zogby was Jackson’s key Arab affairs advisor during his 1988 presidential campaign. Zogby helped the campaign attract more than $400,000 in donations from Arab-Americans.

The recent support of Zogby and his Arab American Institute is notable because during Jackson’s presidential campaigns, the media and Jewish leaders questioned whether Jackson’s pro-Arab views were influenced by donations to his nonprofits. During the 1984 race, Jackson was heavily criticized for two $100,000 donations from the Arab League, a confederation of 21 Arab nations. The gifts were made in 1981 to the PUSH Foundation and PUSH for Excellence. Critics cited a 1979 article in the Christian Science Monitor that claimed Jackson promised political support to the Arab cause in return for financial backing of black efforts in the U.S.

Jackson has had other unsavory relationships that produced gifts to his nonprofits. In 1994, the Citizenship Education Fund reported two donations from the Haitian Embassy: a $20,000 gift with the identification "President Aristide," referring to Haiti’s president Jean-Bertrand Aristide, and a $15,000 gift with the identification "Jean Casimir," referring to Aristide’s ambassador to the U.S.


The Empire star said, “But I am a man of faith and I’m a man that has knowledge of my history and I would not bring my family, our lives, or the movement into a fire like this. I just wouldn’t.”


He added, “Now I’d like nothing more than to just get back to work and move on with my life. But make no mistake, I will always continue to fight for justice, equality and betterment of marginalized people everywhere.”
