That's a double edged sword though. If they prove Barb wasn't in a right state of mind because of dementia, then she also becomes an unreliable witness.

So it HAS to be DNA evidence. I just hadn't really thought about this until a couple days ago because in my head "Chris keeps saying over and over again that he did it" was enough. But then i realized this is also someone who believes they were posessed by a hedgehog for like 2 years.
 
But I think DNA can only show that there was intercourse, I don't think it can show the willinginess of the person.

But if they can prove Chris knew she wasn't in a right state of mind, but Chris did it anyway, would that be enough to convict Chris on rape?
 
He hasn't been charged with rape, only incest right? If Barb isn't in her right mind, then he should have been charged with rape. If she is in her right mind, then she should have been charged with incest as well, but she wasn't. I'm really confused.

The only charge so far is incest, it's been speculated the reason rape hasn't been added (yet) is because they couldn't determine barb incompetent enough and she refused to cooperate or press charges herself.

As to why she isn't being charged with incest? Again this is only speculation but the courts seem to have decided not charge barb because of her age.

i think we've looked into it, and barb may not actually be senile.
she might just refuse to cooperate and tell the court it was not consensual. if she does that, rape is really hard to prove.

the prosecutor has discretion on when to bring charges. they don't have to do it and it might not be good optics to charge her as well. this is still a small town.

The prosecution doesn't want to muck up this situation anymore than it already is.
