No, if you read the complaint including the follow up like docket filing 44, she was subjected to the company’s direction and control and she was an employee of Blaze. They controlled the distribution and oversight of the show, not her or him personally. Blaze contracted directly with her through a Talent Services Agreement and Schaffer had his own separate agreement which was submitted as an exhibit, they were not in a joint business relationship together ever as she had her own LLC which was SW Media LLC. Blaze operated under shared leadership over the show’s production and distribution, they approved format parameters, coordinated content oversight and exercised supervisory authority. She worked on site, she had a fixed production schedule tied to the episodes produced, she used the studio space and equipment, she reported issues up the chain, and she was performing core functions for Blaze’s media platform. The court ruled she plausibly alleged employee status which allowed the case to proceed past arbitration. The proper defendant for workplace harassment is the employer, not a co-host because liability runs to the company when it has notice and fails to take corrective action.

She wouldn't have had standing to sue Schaffer under federal employment discrimination law because the claim like I said runs against the employer, not individual co-workers. Nowhere in any of the filings did they have a LLC together.
