I'm not in the mortgage agency, but given the current situation I could imagine adjusters are under orders to tread lightly. How many "Weeping widows thrown out of their homes" stories do you really want, no matter how justified it might be?
I doubt "go out of business" is really an option for bottom feeding mortgage companies. And DSP isn't a weeping widow.

So is the position still that come 7:30 Pacific Piggy will still be fast asleep with visions of the recently departed Zeus dancing around in his gin pickled dreams and not calling into his strict foreclosure trial that'll likely end in a default judgement?

He's just hoping to have Rip pull him out of a car and say "WHAT'S THAT SMELL?!?" only for Phil to stutter through "Sp-sp-sp-spooo-gee!"

My prediction: Midfirst gets a default judgment against Phil and gets the condo. Further, they get a judgment against Phil for the amount that the CTondo is underwater. The next step would be either a lien against the WAondo or garnishment against Phil's Twitch income.

Bankruptcy is a defense against this, but it's an affirmative defense. This means that Phil needs to raise it up. However, since Phil never responded, he's gonna get reamed and will fall down from the rafters.

He just said they did not notify him, which is "illegal".
This is obviously a crock, since if you have a property, you can be served at that property. If you claim you didn't get notice at the property you owned of the property you supposedly own, that's pretty much on you. He can be presumed to be aware of notice, at a property, about the very property in question, if he is served at this property. Fucking retard.

This makes me idly curious what he does about mail at the CT condo. Does he just let it all pile up somewhere until it rots?

I like how this couldn't be a simple "yeah guys, I have this court thing, not sure what's gonna happen" and hell he could even throw in a "I could probably use some help coming up as I don't know what they're going to make me pay for this condo situation".

Instead he's avoiding the whole court proceeding like a fucking ostrich with it's head in the sand, and his whole story is "nothing will happen to me, it's out of my hands and the bankruptcy will protect me". I think he believes his own lie this time and whatever they rule is probably going to be reported to him by us which he won't believe at first unless it's nothing.

It's like watching someone you really dislike and they keep telling you "There's no train coming" while they stand right on the tracks and the train is blasting it's horn behind them rapidly approaching and you just sit back and say "Whatever you say Phil." and watch what happens.

power leveling warning:

can confirm from personal experience, the judge does not give a shit if you say you wern't told to appear

ignoring every motion so far also doesn't help, fail to plea, fail to respond, fail to appear

I hope he gets slammed with a 5 figure lawyer bill from midfirst, courts costs for 1 year +, I can't wait for the salt

This is Phil remember. Some how, some way the Universe will find a way to make Midfirst pay him tens of thousands of dollars due to financial malpractice or some bollocks and they'll publicly announce that he 'did nothing wrong' and 'did everything correct'.

Does this stupid motherfucker think that firms and courthouses don't send certified mail? Does he think they don't have a fucking record of any attempted service?

How is he this old and this stupid? It's almost like he's used to living in a different country, the way he completely doesn't understand the US legal system. I mean I doubt it's powerlevelling; if you have so much as significant student debt you're familiar with trying to be serviced. They'll get that letter to you and if you avoid it, they don't give a fuck, they have proof they exhausted their options in contacting you, and that's all they need.

It doesn't really matter what Phil does or does not know about anything going on in his life that requires him to leave the Snort Fort. What matters is whether or not he wants to go anywhere. Most of the time he doesn't, and he feels especially unmotivated in this case because it means owning up to a responsibility. He hates that more than anything. Why else do you think he's STILL pissed about OPseats? He lost out on that deal because he's a stupid asshole, and he knows it, but his awareness doesn't give him pause. Never has, never will. His goal in life is to be a piece of shit and get away with it. This is just another extension of that.

I'd caution anyone excited to relax because courts aren't karma machines.

Midfirst might just take the conso and call it a day.
Ditto. Bankruptcy saga taught us all not to expect Phil to be fucked by karma. I'd rather not have any expectations in regards to the foreclosure. If Phil gets fucked, that's a pleasant surprise. If not, well, that was expected.

Hell in some cases he's "lucky" he lives in the US. In my country they send the cops to forcibly have you appear in court because at that point the court thinks that you're trying to skip on your debts. Now keep in mind that this doesn't happen all the time, just in extreme situations like Dave's where he ignored all court summons for a straight year.

I might have missed this but wouldn't any recorded letters go to his Washington state address?

Surely the bank wants to know where you're living and not just what property they let you take a mortgage on since its quite common for people to buy properties just to rent them out to whoever.
