Another thing is escalating force. If a person is unarmed and you’re an able bodied man you’re going to have a hard time in court if you shoot someone. I am not a lawyer but I’ve heard that is a sure fire way to get manslaughter at minimum.
I think there is a significant difference between him making general statements about killing nigs and the /k/ users on their way to a specific event recording themselves saying they want to kill people at that specific event, bringing guns to that specific event, and then shooting someone at that event. The difference might not be enough to spare him and if they do bring charges, the prosecutor will definitely use tweets like this to show intent.

This is retarded and definitely not the legal standard. An unarmed person can absolutely pose a threat of death or serious bodily harm to you. You can defend yourself against an unarmed person who poses that threat, except for maybe in Minnesota which has the worst self defense laws in the country. The problems that Chud has are going to revolve around whether or not him calling the guy a nigger constitutes fighting words, and what Neil said above about talking about his desire to kill nigs.

Two people of /k/olor, BlackPowderRanger (left) and SaigaMarine (right), decided to show up to the protest, stream themselves, and banepost IRL. BlackPowderRanger was not armed that day.

The protesters were on the lookout for white supreme-ists (they literally talk like this because they're niggers) that day and singled them out. There was a video of a wall of people walking toward them in unison as they backed up before the camera cut out. After that, BlackPowderRanger started blasting and hit multiple people. He went to trial and is serving a 15 year sentence.
Oh yeah he's FUCKED fucked if the judge allows this to be admitted as evidence and if the DA is allowed to bring up his criminal history before a jury or grand jury.

That implies a case needs to be built. This tardo basically did everything in his power to not only constantly put himself into shitty positions, and had the courtesy to document all of it publicly in loving detail. Even if this specific incident was 100% no questions justified on his part, he's put himself into the most disadvantageous position possible by posting like this and acting like he did prior.
