Hard disagree, Germany is a confirmed libel tourism destination because of their shitty speech laws. Article 10 of the ECHR is a toothless speech law that doesn't protect anything and is actually used to criminalize a lot of speech. And remember, all this censorship of speech hasn't done anything to make EU countries more polite, because they still have more problems with terrorism and extremism than the US does. If their aim with all this censorship was to prevent radicalization in the EU by banning extremist speech, they've objectively failed at that aim. Censorship clearly does not prevent radicalization or terrorism. (They actually know this, that's why they are resorting to other tactics like increased surveillance and the normalization of movement tracking now.)
I think we're on the same page. As for the mastodon server admins, I think its them hiding behind alleged laws to justify their censorship. The grayness I mentioned is reference to the laws that are toothless but allow people to reference them when justifying a personal action against a user. I have been told about the german governmental establishment banning political parties due to "extremism/terrorism" but they try to get rid of populist parties.
