I'm going to be optimistic here and say chris gets his inevitable charge knocked down from a felony to a misdemeanor,which is a possibility for battery with a dangerous weapon if which pepperspray falls under, so long as mitigating factors are presented. as Chris, while not legally retarded, is so profoundly stupid that anything above would reflect poorly on the judge, this is real possibility. Best case, psuedo-realistic scenario, he gets a year of jailtime and court mandated therapy that would distance him from barb and allow him to at least somewhat improve. Worst case scenario, he gets a slap on the wrist punishment and learns fuckall.

Of course, what i want to have happen is that chris gets charged with this as felony, and gets several years of prison time. An absolute institution is just chris needs to get his shit together. We may lose a lolcow to socialization, but we gain a potentially not-completely-shit human-like-creature in its stead!

Chris isn't getting a felony out of this. That's my personal wild guess.

That's not too optimistic. Retarded manchild pulls off a halfassed attack with pepper spray that doesn't actually hurt anyone... he's not getting slapped with a felony here.

Why not just send Stinky Winky into a kangaroo court and have the judge as an actual kangaroo? At least that would make things entertaining.

You have a right under the 6th Amendment to the United States Constitution to face your accuser in a court of law. It's one of those "technicalities" that people "get off" on in court that the government cant produce the alleged victim as a witness so they don't have a case and it goes back to an idea that if they aren't willing to make the accusation in an open court then it probably isn't for real.

Optimistic to everyone around chris, not to Chris. Chris has proven himself to be fully mentally capable. Immature, but wholey capable as far as the law is concerned. Pepperspray is not a joke, and can cause massive pain and blisters, particularly if inhaled which can then be life threatening. Had chris been competent, then he could have very realistically blinded Mr. Herring. Being charged with a felony is entirely a possibility.

This. I think they're done with the continuances. I'm leaning towards some jail time--30 days or so. I hope the judge he gets is harder than the last one who seemed to want to baby him according to the report from last time. If he doesn't get some sort of jail time he's just going to continue with his brushes with the law until he or someone else gets seriously hurt. He obviously doesn't learn anything unless he is seriously inconvenienced--anything less tham jail time is pointless. Maybe the judge will realize this. Maybe I'm just being optimistic.
 
Nah, Chunkys not going to get jail time for this offence.

1. It's very minor, he's not charged with assault but just releasing noxious gas which is a small felony or mis-demeanour depending on the judge.

2. He's got his get out of jail free card and an old mother he has to take care of.

3. Last time he was in court he was acting pretty cocky compared to his previous visits so that suggests he knows he's not in big trouble.

Verdict; time served + maybe small fine.
