Even if Chris keeps saying yes to have the piercing done? Because the piercer can bring his lawyer and his lawyer will back him up claiming that he has warned Chris several times about the piercing but Chris keeps insisting on it. Chris doesn't and hasn't learned to say no to things that could harm him even if he wants them. If Chris wants something, he'll do anything to get it even if it means spending the tugboat to the piercer just to get his taint piercing.
I'll have to admit I don't know how it's done in the US in general or the state of Virginia in particular, but where I live, there would be one huge detail that comes into play:Every time I go get a new tattoo I have to sign a liability waiver. I'm pretty sure they do that for piercings too. So unless the piercer was really negligent (like using unsterilized tools or something) Charb would probably just be wasting money they don't have on filing and court costs.
But they'd still be an asshole for doing it on Chris.
Just a short conversation (or even one simple look) will tell you Chris is 'special'. So much so that one could argue it's sensible to assume Chris needs a caretaker.
Basically, there is strong reasons to believe Chris isn't able to legally give consent to such a dangerous and difficult piercing (making the waiver null and void and making the whole procedure highly irresponsible). I know that he juristically able to give his consent, but the piercer most likely doesn't know. So doing the piercing is a really reckless thing to do on his side.
If there was a lot of money on the line (and to my understanding, people have become millionaires over hot coffee mugs in the US), I could see Barb arguing her son wasn't able to decide whether or not to get such a body modification. Of course that would mean fucking over Chris' ability to ever sign a contract in the future without a caretaker, but Barb wouldn't give a fuck if she can squeeze some hoard-money out of someone.
And even with all this aside, the piercer could have refused to service Chris cause let's be honest: Chris is a mess. Mentally and phyiscally.
Just a short glance will tell you that guy has issues. Add to that his first experiment with a failed piercing and you don't have to have much imagination to come to the conclusion how it will end the next half a dozen tries.
All the piercer cared for is the money and the ever-so-important waiver that he will bear no responsibility when (edit) the whole thing goes south (/edit). That's shady as fuck.
