I really don't think so.
Some stuffs are illegal, they're tolerated because it causes no harm, but it doesn't make those stuffs legal.

I'm pretty sure that drawing and selling copyrighted characters is technically copyright infringement.
That doesn't mean that the companies that own those copyrights will sue you, but that does mean they could if they wanted to.
And in that case here, that also means the person who drew that art just can't claim to own any copyright on it.

It would be like complaining to the cops that someone just stole something you've stolen first.

This is exactly right as I understand it. Yes, people draw and sell fan art all the time, there are some companies that will do their level best to stop it (guys, was it Anne McCaffrey that lost her shit over fanfic and fan art? Can't remember). It's against copyright, but most entities like to keep the fans happy, and/or don't want to spend the money going after everyone, so they look the other way.

Right. So if people lie about you and cause you stress, that's your own damn fault. If you are betrayed by people who had been friendly to you for years... tough nuggets. Depression is your own damn fault if people are constantly attacking you on social media and everywhere else. Sure. If you just so HAPPEN to kill yourself because people decided to rally and make sure you could never earn a living again... Well! It is what it is! You did it to yourself! It's okay to tear down others to the brink of massive depression because you know... there are no victims here. People can NEVER cause others to stress out and fall into a deep depression. No way! Hasn't stopped people from making bank on commission work and selling prints and keychains and stuff at conventions.

It just depends more on what kind of stuff you're selling. Also bigger companies like Nintendo and Disney are not afraid to stop that kind of shit in its tracks. If you create art of their characters and try to sell it in the form of merchandise, you bet your ass that they'll be on you like flies on shit. There are plenty of people who tried to create fan made things and got taken down pretty quickly. Anime isn't as big and I don't think the companies care as much. I guess it depends how much profit you're making and how much of a pressence your merchandise has. If it is popular and profitable, those companies want a cut, or you got to shut down. That's how I see it working anyway.

I actually feel bad for people who get dragged into situations like this by taking some rando's commission, not knowing they're going to be used as what amounts to propaganda in a culture war.

May, can you share any information about the commission process here? Were you aware of the whole "KickVic" hoax and the legal battle he's been waging to clear his name? Did the guy on Twitter mention he was commissioning this as some sorta "gotcha" towards Dragonball Z fans?

So to clear things up is all about the situation.

I was commissioned by the poster for this piece for an upcoming convention in my hometown where the actress was visiting. He stated that he wanted to get some custom art done to have signed by those voice actors whenever they come, and would like to have it prepared before the convention.

However, the convention passed and he wasn't able to make his payments on time, thus not having it ready for the convention the voice actor was visiting.

The art was as he requested, Broly being uppercut by Panty and Stocking. So I calculated the price of the commission and informed him about the commission as it went to keep him up to date.

He has only recently given me payment, thus giving him the art in return. Like how business would usually go.
No where in the conversation did he say he would use it for such intentions.

I even asked, because I am aware of the situation, if he would use it for such reasons or would like to have another image of the opposite to show that it's an action scene.

I was unaware of the arguments as I had muted the thread to focus on other projects for my business. A kind twitter user, who I shall not name, was a part of the thread and informed me about the poster causing trouble with the art and starting arguments. As you can see.

I went up to him and kindly asked to have the post taken down as after that first initial message, I was bombarded with many dms demeaning my art when I simply did work as told. (I blocked those messages to avoid further escalation.)

I ask him and a friend of mine who's a relative to take down the post, which he did as you can see. However, you can see that I've found many more people posting the art over and over again.

If I had to change anything about this, is probably post a follow up art showing the opposite shot I had in mind. I intended that this art were to be shots from a scene where the characters were fighting in equal playing field. Sort of a set of art that doesn't have a determining end. Because I think the fight would have been long and extravagant from both ends.

However, my thoughts on the issue surrounding it are none. I simply did a piece for a customer.

I apologize about all of this and I don't want to accuse anyone of anything. I'm simply making it clear I had no intent of the results that occurred.

Honestly, you seem like a nice and reasonable person. Sucks that you got dragged into this mess. At the same time, I think you accepting the commission, although you knew that the whole ISWV vs KV thing was going on and that the commission was most likely related to that, was fundamentally stupid.

Also, I think it's safe to say the artwork will be on the internet forever now, but I doubt many people will care anymore after some weeks have passed.

Nobody here thinks you've made a statement throught this picture, nobody said so.
People only pointed at and laughted at the person who asked you to draw it and then tried to use it as some sort of gotcha moment.
You should really stop worrying and move on, this is a 4000+ pages topic on the farms, nobody will ever randomly stumble upon it.

However, thanks for the details about the commissioning process, it was quite informative.

PS: You can still draw the opposite scene and just publish the both of them together if you want to.

That right there was never going to happen. Those voice-actors contractually can't sign fan-art, commissioned or otherwise, and that piece especially was just not going to paint them in a better light if they had signed it (though wouldn't have come off as a surprise). I think the literal nobody who commissioned you had more malicious intent than he was willing to admit to you, and I'm sorry that you had to be unwillingly dragged into this mess.

Thanks for clearing things up. Hope this doesn't lower your morale towards your passion for art. (Your little chill Legoshi from a few days ago is cute btw.)

not quite true. I've been commissioned to draw fanart to be signed by va's and have received signed copies from my client.

I think it does depend on the VA, but going off of how Vic handled his signings, he was under contract to not sign fan-art at all, so I'm assuming this extends to all of FUNimation's VAs. And if the VA(s) he was going to to get the commissioned art signed by was smart, she would've declined it because of what it entailed. None of those actors are smart, though, but it's still scummy to get commissioned art like that signed by participants as a "gotcha" moment.
