I suppose that is the real question. The stay triggers automatically when bond is paid, so the question is twofold:Wait, if he was evicted on the 26th, and the sheriff or whatever can enforce that, how does he "get back in now" that he has an appeal? If you tell the sheriff you're appealing, does he just wander away? One weird trick!
Or does the sheriff now have to revict him and shove him back in? Isn't that a 3rd amendment violation?

Given all the requirements around paying rent even when appealed, I think the process is more designed for businesses and other non-poorniggers where the argument isn't over non-payment of rent, but other failings to comply with lease requirements (e.g., that the building be lit at night, or maintenance, etc).Otherwise, as you point out, the stay is effectively meaningless.
