All I can find with respect to IOLTAs is that a lawyer is required to give a client a general overview of what the funds are supposed to be used for, but I can't find anything to suggest that a client is required to sign off on every single individual withdrawal or line-item expense.

Monty might be full of shit here, yeah. "Funny and weird" story though: I find myself utterly disinterested in trying to defend the integrity of how that case was handled in any way. Mainly because there has already been an ample lack of integrity demonstrated concerning it. That's before we even get to what Monty is now claiming.

Ultimately, I don't know where the IOLTA money went. I just know the two places it didn't go:

1. Quality legal representation.
2. Offsetting Vic's enormous legal fees he now owes the opposing parties.

What I will say is this:

Monty is not the first person to make this claim. In fact, the idea that Nick was getting a "kickback" from Ty was a theory floated by #KickVic very early on.

For example, nominal #KickVic member AniMat made a suggestion back in December of 2019, after Vic lost at the trial court level, that the IOLTA account should be audited.



Naturally, he got ridiculed for this back in 2019 but, now... with the benefit of hindsight... he might have actually had a bit of a point. There was an awful lot of money raised for what turned out to be piss poor legal representation. I too would like to know what happened to more than a quarter of a million dollars in a case that fell completely on its ass in a matter of months.

I realize that a claim like this requires proof, and that may never be forthcoming, but I am not convinced there is an "impossibility defense" when it comes to the idea that some of the money raised from Vic's GFM somehow made into Nick's pocket. Certainly a lot of it made it into Ty's pocket.

Moreover, Nick has an outrageous sense of entitlement that is a lot clearer now than it was back then. Even now he thinks he should have been Kyle Rittenhouse's PR agent, Vic's PR agent, and Law & Crime should pay him $700/hr for legal commentary. He also frequently takes advantage of people for his own benefit.

Is Monty correct? I dunno. I suppose the "fair" thing to do is say this claim remains unproven. However, I will say I no longer think what he's saying here is as crazy as I once would have. Neither Nick or Ty are honest brokers.
