I assume Null is correct and that the prosecution and Nick made a handshake deal that wasn't officially notarized in which Nick agreed to the plea deal with the prosecution if they promised to block the video from getting out. The sheriff, prosecution, judge are obviously all friendly towards each other so didn't think much about breaking procedure in order to block the tapes from getting out. They probably assumed Josh would get annoyed and just back off and didn't expect Hardin to be like a dog with a bone.

TLDR : I think it's less about protecting Nick and more about them not taking Josh's request seriously and thinking they could get away with just breaking procedure and not getting called out on it.
