Yes it is, generally speaking evidence is supposed to be retained until the completion of proceedings + a period after. Now if I understand things correctly, Nicholas being on probation, a continuous legal process, means his case is not considered to have had its proceedings completed and thus all evidence should be retained until the completion of his probation and related processes.

My understanding of the gambit that the lawyer and possibly judge is attempting to pull here is thus:
1. First they get the bodycam considered as not having been entered into evidence which makes any rules for retaining evidence lose effect.
2. The bodycam footage can now be deleted without further consideration as the 90 days for preservation of unused bodycam has long since passed.
3. Obfuscate and draw out the process in an attempt to get away scot-free avoiding any sanctions and in the worst case scenario make the state rather than the judge or lawyer the party at fault so any fines or restitution is paid by taxes while the judge and lawyer escapes any and all sanctions.

They were all living in a trap house where every room had piles of liquor bottles sitting out in the open and furniture tipped upside down among the garbage they were living in.
