We are getting that fotage, we have waited for a year, we can wait more.The Judge approved the request minutes ago. The Prosecutor personally walked this up to the Judge to get it done within an hour of the court opening, because the court knew that 3 women were going to the courthouse first thing in the morning to get the notes.
We're going to sue, but this is a frustrating setback.

Yeah I don't see how this should ultimately affect their status. They were already deemed public documents as a matter of law. Even assuming for the sake of argument that the criminal court changing their status to "Not Accepted" would affect their status as public under 13.82 (which seems unlikely), it would have had to have been done prior to the rulings ordering their release in order to have any impact.I don't think the approval is a surprise, but I really think they are going to struggle to undo the prior decisions on the release.
From what I gather, it is actually already considered public, even if it has yet to be officially turned over.

What would compel a prosecutor to break court precedence over evidence handling? Did they stipulate in the plea agreement that the Kandiyohi County District Attorney must balldoguard the bodycam footage with their life?

There are retention periods applicable to uploaded but not admitted items, per the MNDES guidance I linked yesterday. I did not see info on what those are, but the site states there is one.What's the odds that they move at light speed to delete the body cam footage since it's conveniently "no longer" "evidence"?
There is an obvious necessity for an order to preserve this footage as the evidence that it very obviously is in any action moving forward, because I wouldn't put it past them to destroy evidence.
