We certainly agree that the process was appropriate to determine his deportation status. However, was it appropriate to confirm that he is MS-13? Because this is where the shit flinging will be in the press.
It is not the point of the matter (he was illegally here), but now the claim of him being a (convicted) gangbanger is front and center in all the news.

My understanding is that it does not matter for his immigration status whether he is a convicted gang banger or not, wanting to charge him of such crime was never even mentioned by anyone, but that is where the crazy judge is trying to move the discussion and matter of the case, for the goal "if he is not convicted, then he should not have been deported".

See, being in a regular gang isn’t illegal, though it can be a sentencing enhancement, or it can qualify you for specific diversion programs, which are ya know, for Americans

This is what I was missing. Hearing about being in a gang when people are convicted gave me the idea that it was illegal in itself, instead it was just an enhancement
(edit: to clarify, sort of like it is for a terrorist organisation, so giving support for a criminal gang)

Yes, membership in a gang is a factor in determining priority of deportation, eligibility for asylum, and so on. A judicial determination of this fact is highly appropriate and again, he had his attorney and was able to contest and appeal. He received the process due.

It does, actually. More pointedly, as I said upthread his membership in a FTO (Foreign Terror Organisation) invalidates his order of withholding (which was a promise, revokable at any time, to not forcibly deport him to El Salvador). Mr, Garcia then had six years to self deport according to his final deportation order. When he was arrested, MS13 was a FTO, thus his order of withholding was invalidated, thus his deportation to El Salvador was completely proper. Moreover, even if it was not, his deportation from the US was previously settled. There is no reading of this case that grants him legal status or protects him from deportation.

i checked several news sites to see if there was anything of note that was missing...there just doesn't seem to be much going on. lots of "maryland father" and tariff whining, information about that manlet sped that shot up FSU that already surfaced in the happenings thread a day ago, other misc things that already have threads in A&N

it's just a slow news day. relax. take it easy. put your feet up. take this chance to music sperg or anime sperg or game sperg as a break between politics sperging
