Obviously those results coming back way hot won't trigger a new charge since mere use without possession isn't a crime, and they won't trigger a probation violation since probation conditions hadn't started yet, but his PO could absolutely still use proof of pre-probation recent use to fuck him over in myriad other ways, like making his later testing schedule much more frequent and for a longer period than it otherwise might have been, making home visits involve more invasive searches than previously anticipated, forcing him to do a new chemical use assessment and real-deal rehab instead of acquiescing to Nick's attempts to dual-purpose his the CHIPS-related CUA and "recovery" program outpatient rehab that are now seven months stale, etc. If only Nick had ever had a significant criminal practice, he might have realized just how badly he's self-raking with this "send-off" bender he's been on lately. By Barnes's logic, you can shoot somebody in the head on a livestream and the cops would be like "Awww, sucks. It happened on the Internet, so we can't get a warrant."

There are plenty of times some livestreamer has committed a crime like attacking their spouse and gotten arrested for it. It's true that it's basically nonexistent for the sole basis of a warrant to be something like "being obviously high on a stream" but this isn't such a case.

I'm not sure if Barnes even read the warrant, because it's pretty obvious from the drafting that it was already mostly written by the time of the stream and the mention of it was lagniappe. They already had plenty. Barnes's tard logic is apparently that by including a single extra thing that by itself would be insufficient to establish probable cause, that this additional ingredient somehow spoiled the entire warrant and the mountain of probable cause like presumptively reliable reports from mandatory reports.

This was clearly pure stupidity and Nick ran with it, while carrying scissors in both hands, and we see what the result was.

Kurt, for all his faults and flaws, did the simplest takedown of Barnes' opinions throughout the initial controversy. He thinks Barnes' is a bad legal commentator because he takes how he thinks the law should work (through his personal interpretation of the Constitution) and says that it's the way it definitely works.

What's worse is he routinely does that, which makes his legal commentary nonsense. I don't mind if someone has a fringe opinion on some legal issue and pushes it. I have a few of those of my own. However, it's absolutely essential to point out, when riding your hobby horse, that you are aware you are in fact in the minority and that the majority opinion is X.
