As a former Rackets watcher it has been a bit of a journey. I stopped watching around 2020 but got updates from this thread. It's how I followed what was going on in the Rittenhouse trial, reading people's posts about the trial stream. I was mostly checked out on his content but would follow what misadventures he was getting into. When it was the toast superchats it was fun to laugh about how cringe they were. When it was the locals stuff it was fun to laugh about how he was driving off his audience while being cringe. When it was clear that he fucked up any chance of getting a renewed Rumble contract I had a hearty chuckle at his hubris. His attempt at stand up comedy was like watching a pileup on the interstate during a blizzard. The hot tub stream was bizarre. I was able to catch the coke stream live and that was massively entertaining for all the wrong reasons. Then I check the farms on my phone while working the next morning and find out this dipshit got himself arrested

But I didn't truly begin to hate him until I found out he had been dosing his kid with cocaine. Things stopped being so funny.

Nick's strategy here is to be make it worth more trouble than it's worth for Monty to collect. You can see this behavior in basically every legal battle he engages in. People like Nick rely on the fact that enforcing laws and civil actions are lengthy, expensive, and time-consuming processes to escape the consequences of their shitty behaviors (see also, Ethan Ralph). Settlement runs contrary to Nick's goals of dragging this out as long as possible.

Even if Nick wanted to settle, the case probably cannot be settled unless Monty runs out of money. Sure, Monty has Nick by the Balldo, but both are six-figures deep in this fight and highly motivated to avoid any compromise, so neither is gonna walk away without a significant incentive, which Nick wouldn't be willing to give and it's unclear what Monty would even accept at this point. Nick's only hope would be for Monty to run out of money or energy first, but Nick being Nick would resist any reasonable settlement offer and probably force Monty to knuckle down.

Nick would rather force Monty to go through all the hoops of having to collect than be solvent.

There is a theory that Schneider might have taken Monty's case on contingency (with or without a retainer). Possibly because there is a "history" between the two.

If that's true (and, admittedly, I have no proof one way or the order), Monty's financial burden isn't that high and Nick will not win this unless Schneider gets tired. The appeal victory was mostly or entirely crowd funded, so Monty made out well there.

Nick is burning through an obscene amount of money to fight something that could have been settled a long time ago.

This is why I say, in a way, Monty has already won. This case was not the lolsuit streaming profit center for Nick like he wanted it to be. It is already a massive loss.

You'd think a panel show with actual lawyers including one who had previously been on the defense team would have been particularly good, especially with a case I cared about, but it was shit.
