So I'm looking through the CFAA regs right now. To date a list of federal and state charges Crackieta may get hit with:

I don't think he's saying that Nick sent those emails from Aaron's account. I think he's saying that Nick sent emails which were taken from Aaron's account to others. Nick could have taken screenshots of the emails and then sent them. He could have downloaded them and sent them as attachments.

If that's what he means, then all the more reason to think he wouldn't yet be in a position to unilaterally ascertain what was accessed and sent. If there are no outgoing emails in his sent or deleted box, no outgoing Google Voice SMS messages, no Google Drive sharing or link creation events, etc., then the only way he'd be in a position to "confirm" much of anything this early on would be going into settings for device access logs to the extent visible to the user, which seems uncertain to reveal much considering that the depicted KF browsing activity for pages back in July suggests an exfiltration around that time, long before expiration of the retention period for logs visible to the user referenced ITT variously at 28 days or 30 days.

An alternative way he'd be in a position to know would be having been informed by law enforcement of something they learned using more powerful investigative tools than he has access to. This actually seems more likely considering that the search warrant for Ralph's Xitter activity was issued around the end of September with a deadline for production of the demanded materials no later than October 31st, which lines up quite well with the big news he received on Wednesday, October 30th that got him so "shook" and "out of sorts." Combining what was said then with what was learned on Friday and yesterday, it's not a stretch to infer that he received a security briefing to warn him that his account may have been improperly accessed by somebody as yet unknown, based on something that the known Ralph search warrant (or an unknown other search warrant like it) uncovered, such as Nick and his cronies having sent each other things like this "screenshot" as an inside joke or god forbid even a Werk.

Even if the screenshot did originate as a joke or as a Werk, that shouldn't pose an insurmountable obstacle to investigation of it bearing fruit anyway, so long as the way the investigators use it for next steps is done 100% above board and so long as it doesn't bait Aaron into mistakenly thinking it would help investigators to exaggerate the extent of a breach in any way that runs the risk of being disproven later on, which could lead to Franks Motion 2: Electric Boogaloo and exclude what future warrants find, or otherwise fuck over Aaron's trial testimony's credibility somehow.
