JUNKIE child abuser's legal argument STILL FAILS because what was the existing state of COKIETA-Ville as of the date of the CPS letter OBVIOUSLY was NOT the "state" of cokieta-ville as of the date of the WARRANT and Application affidavit.

2. My guess, Nick POPPED on his weekly drug patch and kids are back with grandma and CPS.

Not aimed specifically at you, more a general question from someone who knows little of law (and is happy to keep a good distance from it) and even less of seppo law.

Does the prosecutor HAVE to offer a deal? It's always mentioned as being obvious that there will be a plea deal offer, but is it required?

They don't have to offer anything. However, they typically offer deals to give people a way out that doesn't waste state resources. Trials are expensive, and the government tries to avoid them when they can.

Nick's argument still fails because he is trying to conflate the CPS case and the Criminal POSESSION case.

On the criminal side, thr search warrant was for drugs. NOT for child abuse. They were after drugs.

The CPS letter was from BEFORE drugs were actually found. Not enough child abuse or neglect to act, in a CPS manner, at the time of the letter.

BUT - then cops go in, and find DRUGS on their DRUG search warrant.
Then the actual existence of drugs is reported to CPS.

Old CPS info in letter, plus New fact of Drugs actually found at residence, changes the CPS decision.

That's my understanding anyway. But Nick is too dumb to keep the cases & evidence separate.
 
He is definitely going to take a plea. He is DESPERATE for that bodycam footage to not reach the Internet. He'll get an offer for probation or something and he will 100% take it, there is no shot he actually tries to fight this. Even if he had a chance of winning at trial (he doesn't), his priority is his "public image" and he doesn't want people to see the disgusting state of the Balldo Bunker.

I don't even think he cares about everyone seeing the photo evidence of the cocaine, I think he's just embarrassed by the state of the home.

No, it just almost always happens. They generally won't bother if they're dead set on seeking the death penalty or life without parole or the worst possible thing, though. The "deal" is plead guilty and we can get straight to the death sentence argument. Even someone like a serial killer often gets an option to plead and get just LWOP instead, at least in death penalty states, but if the prosecutor is determined to make sure they never see the light of day again there's really no point offering a "deal" that is giving them the worst outcome they can get, unless the deal is for somewhat better conditions of confinement.

Considering the case load of the completely fucked US justice system it would be even more fucked if the deal-making wasn't pushed the way it is now.

And in most cases where the evidence is overwhelming it is a good deal for the taxpayer, who finances this after all, to offer a slightly better sentence than what the accused could expect if they were to go all the way with the trial, and save everyone the money and wasted time.

Nick's case is nothing special. Druggies getting caught posessing drugs, even with children in the house, are sadly all too common. So with the level of damning evidence Nick has against himself it is pretty clear cut what kind of punishment is expected for a first time offender.

Nick might have screwed all that up with his repeated, blatant and very public accusations against the courts, law enforcement officers and CPS. The DA could look at this and say "Fuck that guy in particular, that is no way to argue a case. Deal for your wife and the small fry Ape, no deal for the big nosed cuck running his mouth.

I think it's some crazy high number of cases that end in a plea bargain, somewhere north of 90%. Even higher in fed. Court is expensive and takes forever and usually the state would rather get it over with via having the defendant plea, and most defendants are only getting charged because the state is really sure they can prove their case. Knowing they're not going to win if it goes to trial, most are convinced to take a plea by their defense, and most defense attorney work as a whole is negotiating favorable deals as opposed to defense at trial.

I've seen it argued that this system where reduced plea sentences are the "real" intended sentence leads to sentencing slowly shifting higher and higher, but I haven't looked at that in a while.
