Normally I believe court reply/rebuttal calendars are 10 day/5 day. These are "business days" as they are less than 3 weeks. I believe the judge set specific dates but given Nick's retardation, I bet he'll push it as a standard 5 day response. With the past Monday being Labor Day, 5 days would give him until Monday. Calendar fuckery is something that Nick would love to argue.

I'm pretty sure it's not obligatory to file a reply to a reply. And there's really nothing the Barneswalker could file that would repair the absolute disaster that was his first filing, which the state devastated.

So it's entirely possible he just didn't file a reply that he was not required to file.

I'm not even going to dig into the minutiae of Minnesota procedural rules (there are a couple people here far better at that specific issue than I) but in general, if a response is not actually required, all you really lose by not filing some reply to a reply is the option of having done so. You aren't going to be specifically punished for not doing something that is optional.

As shown in the transcript, he specifically asked for the opportunity to file a reply to their brief.

It kind of makes it seem like Frank thinks they got felted beyond the point it could be fixed with a new filing, and to be fair they absolutely did.

I'm still rather surprised because I would have thought that Nick would have wanted a reply even if only to smugly stream about it, since that would give him the chance to project the appearance of control of the situation to his audience for another month or so.

The best part was that the prosecutor styled the reply it as a "memorandum." As if it was a lecture on the law and the facts. Which it was. I don't know how common that is but it made me chuckle.

Ooh, I definitely feel like calendar fuckery is afoot after seeing that. Rekieta asked for 5 days. Judge said okay but then said Sep 6. I think they will all live within their personal calendars. Judge started his 30 day ruling clock on Sept 6 (ruling due by Oct 6). Rekieta will submit his response on the 5th business day (Monday Sep 9). The judge isn't likely to disallow a filing. Prosecutor isn't likely to contest a late filing over a holiday given how weak Rekietas filing is. It will just be Monday and judge will deny it in the next 30 days.

There are types of legal filings. A motion is basically telling the court what the party thinks it should do. And a memorandum is the legal argument as to why it should do that. Depending on the style manuals or rules or whatever, sometimes these are filed as one document and sometimes as two or more.

A memorandum generally has legal arguments in favor of or in opposition to an actual motion, although there are other types of memorandum like a bench memo which is something a law clerk might write to inform a judge (although that is generally not a public document and is completely nonbinding).
